Hi, I am thinking of creating a home video of teaching like the Buck Twins have. My question is, is it illegal to teach some material that was not created by you? I plan on giving credits to the people.

So long as you give credit, it should be ok. Just make sure you state about 3 times who the original creator of the material was, and you should be ok.

A better way to make sure everything is legal is to GET permission from the people that you are going to credit. Otherwise, you may get hit with a lawsuit that you don't need, if you show copyrighted material. If you can't get permission, then don't do it.

If it is to be a commercial venture where the public at large will be able to buy it, or even see it, then yes.
You did not create the material, and the persons that did may have reservations about another person doing that material without compensation or explicit permission. Better safe than sorry. |

We are looking at a succession of ideas here that get passed on from generation to generation. Who inspired the Buck Twins? (Don't know who they are by the way!). In magic it is very difficult to prove anything belongs to (a) or (b). Take Hippety Hop Rabbits for instance. They were invented 12 miles from me in Stockport, England as Norman's Elusive Rabbits. But who is there to defend the successors of Norman these days? And would Norman's descendants even care? It can be a legal minefield in these days of litigation and firms offering no-win no-fee services, so I'd tread carefully, but magic is not like music where Rachmaninov or Lennon-McCartney, or Strauss or Rogers is clearly defined to a work of art. I ask you: What do you want a video for home use for? If you have any plans to develop it commercially, then it's a case of whether you are prepared to step into the grey area!
