Here is a guarentee given by a certain well known magic store regarding the product "Branded".
"Ships today or it's FREE!" Well, my product took 3 days to ship, so I sent them this e-mail: I ordered "Branded" (Confirmation # 20081010202608) two days ago (Friday). On your webpage for "Branded" it says "Ships today or it's FREE!". Looking at my order, it isclear that "Branded" has not shipped within 24 hours. At the time of this e-mail it hasn't been shipped period. Naturally, I would like to claim the free offer. Thanks. I got this back: Hi Devin Thanks for your inquiry. We do not ship the same day orders are placed but do try to ship within 24 hours from that time. However, orders placed on Friday and over the weekend don't get processed until we return to work on Monday and ship out either Monday evening or Tuesday via the shipping method you requested. We see the BRANDED description page as reading Usually ships within 24 hours! The "free" description is in error and must be from an older listing . . . under which section do you see it showing; we will alert the webmaster to correct it. I don't like being a jerk, I have operated my own small ebay business in the past and didn't like them so I'm not trying to be one, but your webpage was false advertisement and I feel it is only right for you to honor it. I got this back: Hi Devin We will ship your order Express to ensure you have it this week. I'm glad they are giving me an shipping upgrade, but they are still dodging the issue. Sadly it's against forum rules to name them, I wish I could, but look around at a popular magic site and you will see the offer on the main page. I just filled out a BBB report today and hopefully that will help. |

HAHAHA. You gave their e-mail, so we know who it is.
They took care of you, so I don't see what the issue is. Don't use them again. Why waste your time filling out meaningless BBB reports?

Lol, oops. It seems I can't edit it either since you posted.
Yes they did "take care of me", but it was only so they could dodge the false advertisement, which btw is illegal. According to state law here in GA (not sure how federal works, but I don't see why it would be any different) they have to honor it. It's only fair business, otherwise anyone can promise anything and label it a "mistake". |

Well, they could give you the run around and nothing is really going to happen as far as the law. You could contact your credit card company, etc. and get your money back.
I guess you could make a crusade of it all and get them to change, but you'd be wasting your time. Find another shop to give your money to. That's always the best way to show your displeasure. If a shop offers free shipping, I generally don't bust their **lls on when it went out, today or 3 days from now. But, it's your money you're spending and you have every right get what you pay for. Good choice on Branded. I'd love to hear how you do with it.

I'll probally just end up going elsewhere for my business as you pointed out.
I'd also like to say I'm not trying to be a jerk and get free stuff. My crusade is based more on the principle of the act, not necessarily the money. |

Oh, I understand. The saying "it's the principle of the thing" strikes home with people. It's good to be passionate about things.
I am curious, this is the first time you ordered from them? If so, you're obviousely experienced, why change shops from where you usualy order from?

No. I've ordered with them before. They always have the cheapest prices and shipping options so I went with them. Sadly, their prices are so low on some items I may still buy CERTAIN items from them, but my regular purchases won't be if I can help it.

Shocking..they aren't honoring their same day shipping or free guarantee. I have seen many threads regarding the same issue.

I know it sound unfair, but also understand their explanation... listing thousands of items and keep up with their descriptions is their responsibility without a doubt, but it is, in no way, an easy task. I think you should have given them a break, take their explanation as true, accept their apologies and the free shipping upgrade, and forget the incident... try to focus in more important things in life... that would have been my reaction anyway.

I am jumping in a bit late here, but they should have honored their advertisement, it would have been more beneficial for them in the long run, from this post alone, I will shy away from them, yes you did get the upgrade, but you had to fight for it, I do not mean fight as in it was an argument , just that you had to chase them, what would have happened if you never contacted them, how long would it have taken, and what happened to customer service, after all, I think you said you paid for faster shipping in the first place, so how much of an upgrade did you get,

Not sure why I am jumping in here but...
I'm wondering where you saw the "ships today or it's free" listing. I haven't seen that on one of their pages in ages. I usually see "ships within 24 hours." If it was an errant listing, a cached page, etc., frankly, I'd be inclined to give them a break. I've been a semi-regular customer of Penguin's and have always been treated well by them. And, their free shipping always arrives quickly, with notification of shipping and order tracking. |
