Do you have a business license in every city you perform?
If you get a call to do a birthday party in a random city are you supposed to get a business license in that city?

I guess it depends on the city and state.

So, do you call each city to make sure?

Normally you need a license from your primary location of business, not the areas you service. It's the address from which you are based. If you maintain physical locations (local offices) in other areas, though, the local laws may require you to get a license. For a performer who travels, this would probably not apply.

I have work in five states (locally), and never heard of such a thing. Is that the way the tax man keeps tabs on magicians out on the COAST?

It's becoming more commonplace as the greed of local governments dictates. My advice is not to seek-out press coverage and the powers that be won't know you're there.

When I suggested to keep a low profile last year (asking for cash payments) everybody jumped all over me for cheating on my taxes, and you were one of them.

Ya...funny story about that. I've been a local amusement parks magician for many years. 2 years ago..I get a nice little love letter from that city telling me I need a business licence to perform there AND that I now owed over $600 in back taxes.

To get a licence in MY city...its FIFTY BUCKS!! They want a $115 app fee then another $60 a year for the licence plus back taxes. Funny what Citys will do when they need money.

Must be an American thing. Never heard of it in Canada. I have a business licence but it is federal and doesn't cost a thing year after year.

Your relationship with the government is just that...YOURS. I pay, but I am not you. If you keep a lower profile and it works then cool. Not "everybody" jumped sir. Every situation is different. I for one will not judge.

I do not get the whole license thingie.

I am a mere senior citizen birthday party magician, who only does shows on rare occasions, because I love the little children. That's my story, and I'm sticking to it.

The only thing is if your income is from entertaining, you do need records for things like buying cars or other big ticket items and the banks insist on seeing tax returns as proof of income. Now whether these returns are real or not or if you have one set for the government & another for the bank is up to you. As for me, that is between me & my God

I've had to deal with this issue ONCE . . . basically, you're "supposed" to get a business license for every city in which you work. However, it's something that the local governments tend to jump on when they need extra cash. If you have a newspaper article coming out for a certain show, or will be getting big press coverage, expect it to be a possibility. Otherwise, don't worry about it unless contacted.

I should add that I'm not a lawyer nor an accountant, and that it might be wise to consult a professional for more guaranteed advice.

The state does not mind what you are a mere senior citizen birthday party magician, who only does shows on rare occasions, because you love the little children, as long as you pay them what they feel you owe them.

your “mere senior citizen birthday party magician, who only does shows on rare occasions” story will not stick if the tax man takes a look at your web site and see the videos of all your shows that includes Community Events, Corporate Events and Schools

I find it hilarious that only California residents have this fear of their local tax collector.

Not sure what you mean there Al...I just hate the fact that they wait 5 yrs and when times get tough..THEN they come after me wanting back licences..back taxes and interest fees. It's just not right.

I am not going to lose any sleep over it nor look into it.

I respect the tax man and give him his due. Not fear him though.

Jim it is when government is not getting enough tax money in that they tend to these things out of despiration. But the whole blood from a stone thing sort of comes to mind.

Well...unlike some of my Café friends..I'm not making 5000 speaking fees nor do I have several restaurants a week anymore nor are my weekends totally filled with gigs. So you you can see why the $600 bill I got in the mail would be a little unsettling.

Al & Sam;

The state you live in has the same rules as California.

This license thing does effect you

Go to this link and read the regulations concerning business licenses

http://www.cityapplications.com/business-licenses/PA-Pennsylvania/biz-Pennsylvania.html

APPLY FOR A Business License
Pennsylvania - PA

"What are the local licensing requirements?

There are no uniform rules regarding local licensing. Whether your business will need additional local licenses, permits, or registrations will depend on the municipality where your business operates. For example, Philadelphia and Harrisburg require that all individuals conducting business in the city, even if they do not keep an office in the city, obtain an annual business privilege license"
