Well, I'd have thought it would be fairly obvious that the legality of such things would variously depend upon what country, state etc you are making the bet in, what you're betting on, with whom, your ages, to name but a few.

Hypothetical example: US, California, betting on a poker game, with a person you are riding the train with, ages of 23 and 34. Thoughts?

Wouldn't it also depend on who was playing the poker? If one person was to use their magic skills to bamboozle their opponent then it would be a different ball game, ethically if not legally!

I'm sure using sleight of hand to cheat people out of cash in a train-carriage poker game would be fraud (i.e. illegal) in most states/countries

You have to define "bets." Government lotteries and licensed casinos are examples of legal bets. Sometimes, raffle tickets can be legal as well if the proper license is obtained. Certain carnival games, depending on how they are set up and run can constitute illegal gambling. My advise is to consult with an attorney who is licensed in your particular state on a specific set of facts! On the other hand, some say an act is not a crime until a judge and/or a jury says so (because we are all innocent until they say so) !!!!!
