You are not being politically correct here, Doctor- shame on you!

You should have phrased that question like this: "Your daughter grows up and meets a man OR WOMAN she falls in love with and they plan to get married"!

Now we are being nicey nice, agreed?

This may have been said before - I am not going to check through 14 pages - but I'll make an effort to get the thread back on track.

As far as I can see, BB's marketing of the book test through Scam School is totally stupid. Who in their right mind is going to pay that kind of money for a trick that he has just exposed to tens of thousands of people? Specifically to people who are likely to be in the same demographic as potential purchasers and therefore their audiences.

OK, he hasn't exposed the exact method, but anyone who has seen or heard about that episode of Scam School knows exactly which three books have been gaffed, and also knows that it is just a clever trick. Would any self-respecting mentalist really perform this effect knowing they are quite likely to be rumbled by their audience?

Brushwood is surely intelligent enough to realise that he has crate loads of white elephants. And he must be desperate to shift them as quickly as possible before his own 'scam' is rumbled.

As collectors' items or historical curiosities, some people may consider these books to be worth the asking price. But to a working performer they are worthless in my opinion.

We can't just let them all stand and just accept them. Points must be addressed before you attempt to build upon them.

Could this be the PENULTIMATE QUESTION!!!!?????

Here it is!

Your daughter grows up and meets a man she falls in love with and they plan to get married!

Wonderful.

Quote:
She brings him over to meet you!

You find out he is a magician!

Poor girl. My wife will probably do her best to dissuade her.

Quote:
He has taken your trick years ago and sold it under his own name . . .

That's arguably fraud, and he would likely be exposed, just like so many are exposed when making "knock-offs" in magic now, where there is no real "legal" "protection" against such.
Not that all knock-offs are necessarily fraud, but I digress.
So, he likely would have a reputation in the magic community, just like certain people and companies do today, and my daughter would probably have looked into the guy once she found out he was a magician. She would also likely recognize the effect once she saw it, or found out about his reputation.

Quote:
. . . and made a contact (one you were trying to get but were told someone else does your stuff and they are cheaper! - this is the guy) that got him into TV

Then either I was over charging, or they clearly did not care about the quality of the act. So, it's highly unlikely that they would see much success, relative to success I would be seeing. You get what you pay for.
Again, this is assuming I am doing my own material better than someone copying me. Not to say others don't get successful doing other people's material, however, in the end, and EVERY professional will tell you this, you are selling YOU, not the material. YOU are the product. That;s probably the most valuable and important piece of advice any performer can get.
Alternatively, If, for some reason, he is actually doing my material BETTER than me (which means he would have to do far more than just copy me, so he would have already made it his own, if you will, just like most magicians do with any effects they learn, no matter who created it) in which case, the better performer got the job.
Here's a small secret for you, when you sell your tricks, other people will be making money performing them :O

So, if you sell your tricks, how can you be angry about other people performing them and getting work? At that point it's completely irrelevant how they learned your tricks if you've been selling them. If you don't want people doing your material, don't make it available. As you are about to bring up, that can happen through just performing, so don't do that either, as you know people rip off other performers material as it is now. Just look at comics. Of course if you aren't selling or performing, then no one will know you, or your material, so you won't have much success as a performer any ways, so that will be your own fault. If you want to be a performer, you have to expose yourself.

He freely admits he trades ebooks and downloads and uploads- he does no think this is piracy as ideas are free once out there.

He watched an entire show of a friend of yours - and he loved it so much he took the entire script and used it as his own verbatim - and that contact gave him corporate gigs!

Like I said above, the only way he would be getting any significant work is if he's either a poor performer going cheap, in which case those hiring him will be buying a **** product, and that won't last long, or, he's taken the ideas from my friends show and made them into something more marketable, and he's doing it better. Like I said, he wouldn't be doing a better job if ALL he was doing was copying it verbatim. He will have needed to add something to it to make it better, and make it his own, just as, like I said above, we all (should) do when we are performing tricks we learned from others.
Look a paintings, many people, even in art schools, they do this as an exercise, try to paint near exact duplicates of paintings. People are not interested in buying the "forgeries" if the original is available. Prints and "forgeries" will look nice, and can be nice to have, but everyone knows they are nothing compared to the original, and these are works WAY out of copyright. The only way someone will be valuing the derivative works over the original is if they have done something MORE with it. If they have made something extraordinary with it.

Quote:
He laughs how he confides in you a friend of your daughter's (whom you thought was a real nice person) had a crush on her, and was writing poetry to give her... well, this fellow confided in your future son-in-law and shared the material for his opinion... and yep, he decided to use it himself, impressing your daughter at the depth of his feelings he can put in words... the other fellow, heartbroken left to join the Foreign Legion.

Again, could be considered fraud, and he would have been lying to my daughter. Do you think she will want to be with someone who built a relationship on lies? Lying (generally speaking) is not illegal either, but people usually still frown upon it. Like I've said before, "IP" "violation", and "exposure" CAN be prick things to do, just like lying, but that doesn't mean people don't necessarily have a right to do it. Just as freedom of speech is for protecting unpopular speech. There's no real threat to censor popular speech. People have the right to be jerks sometimes.

Similarly, the friend learned not to confide in this guy. That kind of thing is completely possible now, and it's not exactly illegal for someone to use information you told them, in confidence, against you. If it were, more than half of high-school students would be in jail. People learn who they can, and cannot trust, and you just don't confide in them. Keep your secrets to yourself and those you can trust, in other-words, keep your secrets to yourself Smile

Quote:
Your wife recently gave a speech your daughter took this fellow to... and he loved it so much he wrote it up as his own verbatim what he heard and submitted it to Salon and got some dough and press.

Again, fraud. It could be argued that he defrauded Salon. Also, if she gave this speech, there would be public record/witnesses, so, again, there goes his reputation, especialy in the eyes of my daughter, as she was the one who took him to the speech given by her mother.

You really think she wouldn't notice?

Quote:
He asks to chat with you about your ideas in magic, business, personal things... hey he will soon be your son in law...

I think at this point she would have already dumped his lying ass, but if you REALLY want to pretend my daughter is that stupid at this point, lol, let's continue.

Quote:
OK I lied - I have a few questions for YOU!!!

1) Do you tell him anything of value or keep it to yourself and tell him crap?

I probably wouldn't tell him anything. Why should I?

Quote:
2) Do you have any moral repugnance for this person?

As a lair, and a manipulator, sure.

Quote:
3) Do you want this person part of your family?

Again, as a lying, manipulative, arguably borderline conman, probably not.

Quote:
4) Would you talk about your concerns with your daughter (if you had any - which you might not...)?

If everything happened as you described, I wouldn't have to. If, for some reason, she was completely oblivious to the fact that he was going around lying about his magic and speech writing, taking credit for what her parents did, then I might point those things out to her.

Quote:
5) Do you show him to the shed to display your collection of finger, head, and other choppers... being he is interested in magic and all that...

I don't care to share with, or confide in, a guy who has shown he is simply untrustworthy, so why would I show him my magic collection of bodily severing props.
I'm also not a fan of any violence or force used out of anything other than in defence. I'm also not a fan of insinuating violence, or threats.

It was a hypothetical simulation - I just used, as in most texts a demographic... But it was an arrival situation which likely won't o cur as gdw daughter likely would have never gone out with the bozo in the first place - I spun that synthetic tale just to try to create an expertise narrative to understand gdw in terms of practical application of his ideas... And as I said above, he likely would slay a villain as much as the rest of us.

But as with all sims - thank you for the feedback and ill work that into the next iteration - hey I'm not perfect. Never claimed to be.

So, has anyone here actually ordered this?

If enough of you want to contribute a buck or two or three to my PayPal account, I'd be glad to take the plunge.

I'll come on here and give a public review if I can get this going.

And for those that contribute to the cause financially, I'll send you a PM and tell you everything that you want to know about the workings of it.

I, of course, will own the Physical Property, but all of you contributors will own the Intellectual Property. Socialism at it's best (at least in my view).

How does that sound? Any takers? Or I should say- Any givers?

IP is not an assault or attack on my customers. A LACK of IP is an assault on me, my livelihood and the way I make my living.

You may think I sound ridiculous for getting so worked up about this, but it's the way I make my living that you're attacking. I make music as a hobby, not to put food on the table. Yes, I've dealt with ASCAP. I've dealt with all kinds of licensing companies, unions, etc. Are they perfect? No. But they're there for a reason - to protect artists.

I make my LIVING making television shows. That's what I do on a day to day basis. If you think I'm just gonna sit back and go "ah well, times are changing" you're very mistaken. This is how I pay my bills and put food on my table. Television networks and production companies pay me money to make a product for them. You keep talking about resisting change. So, because it's easier to steal a product now than it was 25 years ago, that makes it acceptable? You couldn't be more incorrect. What a ridiculous assumption - I spend months, YEARS of my life on something, hundreds of thousands of dollars, if not millions, go into creating it, you think it's okay to sell one single copy for a few bucks and duplicate it, use it however you please, and not care how it affects me. THAT is stealing. If you don't like that term, come up with something else but what you're doing is taking food off of my table.

And if you're sharing files, what does that make you? You're the fool who paid ten bucks for a CD or a movie and then put it online for others to download. You paid the money and then gave it to thousands of strangers for free. Makes you look pretty ridiculous, doesn't it?

I'm curious what you do for a living, Glenn. How do YOU pay your bills? I can't imagine you'd take too kindly to someone coming after the way you make money. That is EXACTLY what piracy and theft of intellectual property does to me and to all of the other people in this business. I work 60, sometimes 70 hours a week to create just minutes of television. Don't tell me you now own the rights to my product and expect me to not get defensive. It's obvious you're vastly uneducated in this arena and your livelihood doesn't depend on it. Mine does.

Judging from his go-to analogy, my guess is that GDW works in a knife factory.

Well said Andrew but I wouldn't let one persons ignorance bother you too much. Its a fantasy world and thankfully there are laws to protect against people that conduct themselves in that way.

I don't agree with GDW (as you might have guessed), but I believe he is truthfully stating his position. I think, perhaps, the only way for us to understand his position is to do what he recommends. If anyone currently owns "Mobius Switch," Glenn says it's yours and he says you can give copies of it to whomever you like. Perhaps you should. The artist has given you permission, after all, so even if you believe in the fallacy of copyright (according to Glenn) it no longer applies. Here is what I would do if I possessed a copy of "Mobius Switch"... Put a nice complete HD version in my online storage and email the link to everyone I know with this accompanying text:

Quote:
Here is a link to "Mobius Switch" by Glenn West. He does not believe that this should be protected by copyright even though he released it under the provisions of the existing law. Glenn West wrote, “You have no inherent right to control what people do with physical property they possess, and you have no right to control what they do with ideas and information they possess. You also have no right to stop that person from sharing that information with someone else.”

He has clearly stated that he believes that once anyone possesses information, they can do whatever they want with it, so you have the artist's permission to share "Mobius Switch" with anyone. Glenn West wrote, “The artist still has every single last thing they own, and the person copying is only doing so with property they legitimately own/possess, and this includes the information that the artist willingly gave to them," and "I have no right to then control what you do with that information,” so I have given it to you because Glenn West said I have a right to.

At this point, there is no need to pay for it, it is aleady yours. If you feel strongly about copyright protection, please forward this message to everyone in your address book, and share it on Facebook or by any other means you want. Also, do not worry about the publisher (Blue Crown), because Glenn West has stated, “As for potential earnings, they never had them in the beginning, so they can't have had them "taken" from them. You don't "own" potential sales, you must earn them. No one owes you their money for your work simply because you worked.” We should let Glenn West explain everything to Blue Crown.

In closing, Glenn West made his position perfectly clear when he wrote, “I am against copyright, and all IP laws for that matter. I think they are morally corrupt and founded upon monopolies and greed, and now propagated by ignorance,” so thank you for participating in this social experiment to see if he is correct.

OK.

I'm on your mailing list, Dan, since I've purchased from you before. And I just picked up "Vortex" from Penguin.

Anyone have anything more to say about Schwood?

So far Im have no givers in order for me to get a copy of his Book Test. I'm surprised.
