Maybe one should just turn the table and ask the USDA what would they suggest for a disaster plans including all situations. If they cannot or do not answer, then answer how the hell do you expect me to come up with one then?

Is it really such a big deal though? You type up the document once, and barring and major changes your all set. If you are going to use animals in your act than I think every detail should be accounted for, and people should be held reasonable for them. Yes, I think the government should get involved and force people to actually have a plan for their animals, if they do not then who will?
And to everyone complaining about the government not forcing people to have a disaster plan for there families, I should hope that the Government does not have to tell you to do that, that you already have a plan. |

In my opinion of course
I do not think the Gov should be involved in this, I do not want people who salaries I pay wasting time approving or disapproving a plan for a magicians rabbit, and I do not want the Gov telling magicians they have to practice rabbit safety drills. When no one speaks up this is what happens. The law is accurate for 1946, we republished it on April fools day a few years back (which is why I remembered it) but it was originally printed in Tops Magazine 1946.

Here is a followup to the story in June 1949, a short article on page 19 titled NY Magi Wins
Magicians of New York State are now moved several notches higher in the estimation of the state government through the passage of the Turshen bill, which was signed by Governor Dewey on April 27. This bill, which has been pushed by Samuel Safronoff, Brooklyn attorney, members of The Knights of Magic, and others for several years, reduces the ,scope of laws long in effect which characterizes Magicians, mindreaders, jugglers, wire or rope dancers, and performers of puppet shows as disorderly persons. The new law eliminates such performers from that category. |

Dazmagic above posted a link to a Heritage Foundation article. According to their scholar, the regulation means that a magician must anticipate every possible disaster at every possible venue in which he/she will perform every year. That sounds very serious. At the very least, these regulations represent major intrusion of government.

I too, got my letter from the USDA, and my answer is so simple, that I'm not sure it is adequate. I'm 62 years old and I have lived in the New Orleans area the whole time, which of course has seen it's share of Hurricanes. I have never evacuated because of a Hurricane.
That being said, I own 3 rabbits, 1 dog, and 1 large bird. If I felt the need to evacuate because of pretty much any disaster, then of course, all of my animals, and bird would come with me. If my house got destroyed because of a hurricane, tornado, or fire then I'd react as best as I could. Is this good enough for them? I'm not sure. |

Hi Wizardpa: I just got a most welcome call from a nationally known emergency management expert, who has written plans for FEMA, military, states, cities, and large industries. She just wrote a plan for a large cattle operation which has 50 thousand head of cattle. She thought this rule was so ridiculous, she is going to write my plan for free. Looking over what the USDA wants in this plan, she estimates it will be 60 pages long!!!
She even brought up the fact that if I go on vacation and have a pet sitter, the pet sitter must be trained in how to implement this plan. This is how out of hand this has gotten. |

Well I wrote up my plan. It seems somewhat simple in format to me. Basically I list the disasters that I might have, and that I would treat my rabbits as all the other living things in my household, including my bird, my dog and even my wife, on how I might treat each disaster.
Of course that is not how I worded it. I mean what else would I do? Evacuate because a hurricane is coming and I'll just let my rabbits starve to death. Know that I have a fire and not try to save my rabbits. I'm now into my 3rd. year having a USDA license. I got my renewal in April, but my inspector has not come yet. I guess he is waiting until after September, even though I needed my plan written by July 27th. I do not expect my inspector because I guess he is waiting until September so that I have time to train my employees. The funniest thing about all of this is if I raised rabbits to eat, I would not need anything. |

I have always shown up everywhere with tons of nerdy paperwork. It has saved me a lot of agitation, many times. When we magicians have the latest and greatest documentation, the feds love it. That said, this particular requirement is pretty challenging. I have followed a few links to disaster plan worksheets. Yikes. I am trying to come up with a generic 1-page or 2-page document that most of us can use. It may take a while to finish … may not even GET finished. Not that the plan for most of us would be that difficult to detail. Just the opposite. What we would do is so basic and simple, the hard part is coming up with enough bureaucratic horsesh#t to fill a page convincingly. If I DO come up with a decent document to use, I’ll post a link to it here on The Magic Café board. Hmmmph. Wish me luck. |

My FOX appearance got bumped by the Royal Baby--go figure LOL! They are working on rescheduling for Tues or Wed--no guarantees but we'll see. Also, Paula, my disaster plan is online at the Washington Post story--see link above--and you may use it. Will need to change the specifics for yourself, but it is pretty complete--28 pages for one rabbit!!!
