You seem to say mitigating factors don't matter, then go on to list exactly why they matter.

I guess I wasn't very clear. I was trying to say that mitigating factors are weighed by the judge in making a sentencing decision. It is built into the sentencing matrix in capital cases. Judges have a hard job in balancing the scales of justice.
Most of what I stated is explained to the victims by the States Attorney (prosecutor by whatever name) as sort of a truth in sentencing exercise. Imagine how the victim would feel if, in the courtroom they heard the judge award a 10 year sentence and a year later the perpetrator was released and was free! Try then to explain medical parole. The whole process is not set up to take care of the victim. That has been slowly changing over the past decade but it seems that the victim gets hurt twice once by the crime and once by having to sit there during the prosecution of the case. Sometimes the outcome hurts the victim a third time. Often the only satisfaction the victim gets is knowing they were believed, the evidence supported them, and the villain that did them harm was found guilty and awarded a sentence. No matter the moral outrage or severity of the crime the process is there to protect the accused. The concept in U.S.A. law is that one is innocent until proven guilty. We get to try folks in the court of public opinion, on social media, and in the media, the courts do not.

You may not believe this but they covered some of this in the police academy I attended.
He is a serial offender who gets out in 3 years. You can try to hang an air freshener on it all you like but that is the bottom line. He HAS been proven guilty. (I am the biggest advocate of saying wait for the process to play out we have here.) So what is your point? He was tried in court. So it is not about moral outrage or any other words you want to put in my mouth. It is simple and I'll say it once again. A serial rapist is out in 3 years. That seems pretty light sentencing.

Danny, I've been upset by the sentencing myself.
The outrage we feel is, however, outside the processes of the legal system. Not the "justice system," but the legal system. One woman provided a case that could be investigated and tried. And so he was sentenced (too lightly, I also believe), and he is now in jail. But regardless of the lynch mob mentality going on in America right now (Lincoln's perpetuation speech, anyone?), Bill Cosby's case does upset us beyond what could be possibly made "just" regarding the damage he has done. Here is the elephant in the room: he was--by far--the most beloved African American in American public life. He was so beloved he wasn't even black anymore: he was above race. White guys like me could feel like he was my grandpa! He was also--importantly--one of the few black Americans who repeatedly told young black Americans to clean up their act, to stay with the mothers of their children, to avoid those stereotypes that harm the image of young black men. His hypocrisy may have only been proven in one single law case, but millions of Americans are so sorely disappointed, so disenchanted, so it's-time-to-vomit-now disgusted, because we have enough accusations to know that he is a MONSTER, that we would like him to sit the rest of his life in jail. But what jail, what punishment, what justice can seem enough for America's favorite grandpa (a black man) to have been proven to be a MONSTER? Our disappointment is just too great. "To Russell, my brother, whom I slept with"? Monster. Fat Albert and the Cosby Kids? Monster Jello pudding? Monster. Cliff Huxtable? Monster. Drug women and rape them? Bill Cosby? Monster. Bill Cosby, monster. I am so disappointed that I just feel ashamed. Whatever sentence he got could never be enough for me to feel that the damage he has done--on dozens of women, but also on millions of African Americans, and also on millions of white Americans who loved and admiree him--could never be enough. As most of you know, I speak carefully. Bill Cosby has done more damage to American cultural life than any other popular figure ever. But his sentence was legally appropriate. It just wasn't justice. |

No. Sorry Jeff. Well not no completely by maybe yes "and".
For what it is worth I separate the things you speak of. My problem is with a system that allows a serial offender to walk in 3 years. Was it legal? Of course. But such a system is flawed in many ways. This is onky the women who came forward. Tip of an iceberg is what that is. And the system is what KEPT them from coming forward earlier. Once his time is done the system exists and untold numbers of women will still be afraid of coming forward. Especially if the serial rapist only gets 3 years.

At last report, Bill Cosby has a cellmate who is being paid to care for him. I guess it is allowed for inmates who are elderly or debilitated.

While nobody on this board condones rape or rapists, there is something to be said for a society.
"Punishment" given by society is much different from a punishment I would like to see inflicted upon such a person if it was just me. Society has established his punishment. Part of that punishment is not abuse. We should not torture people for any reason as a society. Not to get information or to punish them for heinous crimes. So while I see and understand your position about a rapist, and am absolutely appalled by his actions, as a society we can not condone abuse. If we go down that road it gets really ugly for humanity. Our country is simply not supposed to go down that road. It is not about "diminishing" you in my eyes. (As I see your position and can actually identify with it.) It is about our culture as a whole. This is not bashing you in any way, or even really disagreeing with you. Just clarifying the difference in personal preference and what what society must not condone.
