Yes it would be a greater hardship for a person of average means missing a days wages.

And those who complain about those who complain about blaming the victim often try to elide that point for reasons best known to themselves. BTW, for the record, as far as the known facts have come out, I don't think Dao was an idiot at all, but being assertive about his rights. But in any case, whether you think he is an idiot or not has nothing to do with the case. The question is whether his rights were being abrogated by United.

A New York woman filed a $150,000 lawsuit against United Airlines on Monday, claiming she was forced from her business class seat to the back of the plane by an employee without any explanation during a flight last year. Funny that it wasn't an issue until now...

(A) Maybe we have reached a tipping point where passengers are sufficiently fed up with the airlines treating them shabbily and we will see more of these cases; or
(B) maybe we are witnessing the press creating an outrage monster that feeds upon itself to further outrage for the sake of outrage (and the concommitant 'news' stories about that outrage). There are probably other analyses. It looks like everyone involved behaved badly. The airline screwed up in trying to throw the passenger off the plane; the airline staff screwed up in trying to forcefully remove passengers already boarded; the staff compounded the problem by calling in force (Airport Police); the Airport Police screwed up by using uncalled-for violence; the passenger screwed up by making a scene; the CEO screwed up by failing to acknowledge that the issue was inappropriately addressed by its employees; etc.; etc. There were plenty of errors and screw ups all around. So maybe the whole issue was just a confluence of poor choices by the people involved. Or maybe it was just a bright line showing the systematic disdain and failure to consider the passengers by the the airline. Or maybe something else. |

Well clearly a series of very poor decisions were made.
But with the millions who fly hard to call it more than isolated incidents. Make no mistake it is partially media feeding outrage. Still very wrong to beat passengers mind you.

Did the airline crew actually try to forcibly remove him or was that just the "police" crew?

The aircrew did not physically try to remove him. They instead contacted the police and had them do it.
That is why I find the fault to be theirs. They escalated a situation that could have been resolved much easier with many, many other options.

Since Jon posted a link to the video again, I watched it again, and found it more nteresting this time, and am curious as to what you lawyers and law enforcement people think or have to say.
On the one hand, it doesn't look like the police were particularly violent, but that Dr Dao was somewhat hysterical, which escalated the situation. On the other hand, "hysterical" could be the sign of something other than being a drama queen: the man might have what Americans typically call "issues", though we don't know what those issues might be. But theoretically, should police need to physically subdue someone, should a handicap be taken into account? Can someone be yanked out of a wheelchair, for example? What about people with Downs Syndrome? PTSD? Hysterics? Another point: regardless of how I (or you) see the incident, those on the plane seem rather vocal about Dr Dao's treatment. Were I a lawyer, I'd be watering at the mouth for this case on that fact alone. The jury on the plane seemed to think Dr Dao was being handled terribly. (Of course, not all passengers were vocal. Maybe the "silent jury" thought everything was OK.) |

United Airlines reports that the bunny injured itself while falling, but luckily a fellow passenger was able to take this candid video of Airport Security escorting the bunny off of the plane....

I'm assuming that there must be an airline security camera that filmed the whole event from start to finish. (If not, why the heck not? Wouldn't that be anti-terrorist Security 101?) I wonder when that's going to surface--or be demanded as evidence by Dao's lawyers.
And very tangentially I was asking myself this today: was there ever a case in the history of US law enforcement when the police intervened to protect a worker's or customer's rights against an illegally acting owner or corporation, instead of the other way around? It's an interesting thing to think about.

Example - customer won't leave a business because of a dispute. Criminal trespass. Business owner allows the police on to remove or arrest him. Customer ant find his cell phone; an employee must have taken it - sue the employee (or business). Want it investigated? I'd the business owner is a jerk, got a warrant? But for criminal allegations that can be legally investigated, sure. Bernie Madoff didn't move to prison for the food. Case in point is a good example - before the fuzz showed up, UA alleged trespass; Dao alleged breach of contract. Only one is a police matter.
