I performed a trick for these guys, it was not my trick it was “Departure” Jim Swain. Anyway one them works for TV, he is a set designer so he is no expert on the following subject, but he said.
“You should sell the television rights to that!” I told him it is not my trick and I did not give it any more thought but the question is: If you invented a new card trick can you in fact sell the TV rights to it? I did a search here and it talks about “products” and stuff but I would like to know if the TV rights to a “Card Trick” can be sold. Tommy

I am not a lawyer. But if the card trick is yours and only yours I cannot see why you cannot sell it. Of course this means that the card trick in question is not a variation of any others and is not published.
I was, by profession, a software engineer. And because of such I utilized loops, if statments, bubble and binary searches and more which I will not get into here. Now these were all done before I even started to create software, or even learned how to create software. But, I have used them in writing new programs. So can I not now use the above to write my own program in order to create something new? I think not. As a matter of fact I know not! If I could not use the above then we would not be conversing here! So, go ahead and sell anything that is YOURS and ONLY YOURS! edh Just my opinion. Hope other will respond.

I know I can sell a trick that is mine, but that is not what I mean. I mean if I sold the TV rights to perform that trick to (a) and (b) performed that trick on TV without permission, then would (b) be compelled to pay (a) for doing it.

Basically yes, I believe it is basic international intellectual property issue. Very hard to monitor but still possible in theory. In fact, there are trick like that such as Healed and Sealed Soda. David Blaine had bought the tv rights.
You can sell your trick or performance as you wish. If the tv channel already has a magician they may want to just pay for the effect, if not they may want your performance. Anyway they will happily pay because it is just raw materials for a profitable show. Not to pay would be like a chef stealing eggs. I am not even sure how original the trick has to be in order for you to sell tv rights? It is not a patent application or even a claim of a copyright. You are merely selling something that you do and agree not to sell it to anyone else. A minor variation could be ok. Say twisting the aces with a political theme or sponsor logo. |

OK thanks. I do not know why I asked now. It just was bugging me. I have no idea how show business works I just know there is no business like it.

I believe with Healed and Sealed, you purchase the trick with the understanding that you cannot perform it on TV until 2006 or 2008 or whatever it is. I believe it is on the back of the instructional pamphlet.

On the Healed and Sealed note, this is from the back of the booklet... "In May 2002 David Blaine performed his own handling of this on his show 'Vertigo'. Please note that David Blaine is holding the exclusive worldwide television rights for this trick until the year 2005." So it seems it's available to perform now, unless he updated his rights. I don't know about selling rights to tricks, but it seems logical that you could sell TV rights to an effect that you create, or keep them for yourself.

So who did blaine have to pay to Perform the invisible deck? That belongs to more then one person it think.
