All good advice. I am a film/video editor by day and you can produce a film quality production on a desktop computer which was unheard of not too long ago. As far as on the cheap, most prosumer, under $1000 mini-DV cameras will do the trick for quality video and should have audio inputs. don't underestimate how difficult audio can be - it can be very challenging to get clean, quality audio. Check out a video equipment rental store in your area - day rates are not as expensive as you think.
Lighting is everything as has been said, but don't forget about the sun on an overcast day (best shooting conditions for outdoors). Three-point (or portrait) lighting is easy. Also, underlight just a bit, which means don't have too much light blowing out the image. Contrast, or undiffused lights, may be nice for a gothic or mysterious qulaity. B&W, too. If you have a macintosh, their software (Final Cut) is the best IMHO. Others have mentioned the best inexpensive PC packages. I think the latest version of Adobe Premiere should suffice. Also, correct me if Im wrong, but unless you are selling your footage as a magic performance DVD or whatever, I wouldnt worry too much about music royalties. Are you making a profit off your project? Then absolutley get legal permission. If not, its courtious to ask permission, but not reuqired. Post-production editors, film students and cinematographers use pop music on their demo reels "all the time". -- Tony |

Tony, this would just be a demo video for my website. Showing potential clients what I do. I don't need permission for this? Are you absolutely sure? I would hate to be sued or something.

Ive never had or heard of any problems. How is a music company going to know what you're up to anyway? Besides, its just free publicity for them, the songwriter, etc, if it is not a commecail release. I have lots of different music in my demo reel: Thievery Corporation, a Morrisey song, Radiohead, etc. sometimes just a portion of a song Animation or film footage highlights are cut to the beat like a music video. Its quite common. Corporations create internal marketing videos with themes like Mission Impossible, etc. just for employee kick-off meetings as well. Call a local post facility or audio post and ask their opinion, too.
Good idea using video marketing to promote yourself. Look how effective Blaine's street magic special was... kind of a portfolio of abilities when you think of it. -- Tony |

What about this part under section 2?
"There is an exception for personal copying of music, which is not a violation, though courts seem to have said that doesn't include widescale anonymous personal copying as Napster. If the work has no commercial value, the violation is mostly technical and is unlikely to result in legal action."

Bad advice? Technically, and even morally you are right, especially if you are a musician! Im curious. Have you ever heard of anyone being busted for this sort of thing? That would definitely worry me! I don't mean to sound glib about copyright laws, but a big music label just isn't going to chase down one independent magician because he created a homemade video for non-commercial purposes. Yes, you "may" benefit from using the music if you get a job, but your are selling your magic skills, not music skills.
If you still have weak knees, check out ACID Pro 5. Its loop-based music composition software. http://www.sonymediasoftware.com/product......?pid=928 -- Tony |

If it's for non commercial use, just mention at the credits the track you used with the copyright info of that track. if you don't wanna do that there are tons of "royalty free" music tracks, some of the tracks are really really good! if you want to get into composing music (which can be fairly easy with all the softwares around) would go with intofx's advice and get ACID Pro 5. I personally use "reason" by propellerhead (NOT for beginners,DOESNT use loops,PROFESSIONAL, you better have a keyboard - musical keyboard - with midi output blah blah blah...and another down side it is EXPENSIVE!) you can dowload demos, but dunno what are the restrictions, as for editing, you can download adobe premiere, fully functional for 30 days! hope this helps...

That's why they have ASCAP, BMI and groups like that. You wouldn't believe the lengths they'll go to "catch" people using music without paying royalties. I could tell stories for days. Basically the band I was in was playing public domain music (Irish trad stuff, literally 100s of years old, with no known composer) in a bar. They came in and tried to shut the bar down. We lost the gig for about six months while they figured out there were no royalties to collect. On the positive side, we were in the right. On the negative side it costs a lot in legal fees to fight these guys, even if you win. . . which doesn't happen much. Bar and restaurant owners, musicians, and videographers (making personal "non-commercial" videos for weddings, parties, etc.) live in fear of these guys. Just be careful. Mark

It is only common sense to contact the copyright holder, for a few moments of a piece, they may well agree that it helps to promote them as well, especially if you give them a plug on the site, BUT you will have that permission in writing.
The video may be for "personal use" but as soon as you put it onto your site for customers, or potential customers to see, and the site has a way for them to book you or contact you for booking, I think it then becomes commercial in it's use, if not the intent. You would be surprised as how many individuals holders of copyright will give permission if asked nicely. Be clear about your uses and needs, and respect theirs. They may have conditions set on it- no more than 30 seconds, etc. but you need to ask first. Oh, and do it by snail mailed letter, not e-mails if you have the time. To many, a well done letter on nice personal letterhead seems to iindicate a level of prefessional respect. On the issue of ASCAP and BMI, and those folks- Too true, did you know that a commerciall business or store that plays the Radio, so that customers cna hear it is subject to the fines and fees?! I do! How silly is it for a 125 sq. ft. store to have to pay monthly dues so they could have the radio on inthe store during business hours? Now THAT is the worlds smallest joke book!

Yep, Kay, I totally agree. For organizations that are supposed to be protecting the rights of composers they all too often abuse their power.

You guys are right. I typically use commercial songs on my DVD reel and I control the distribution - putting it in the hands of those potential clients and peers that want to see my work. It is a different story when you post a clip on the web for all to see. That said, I have lots of respect for professional indie musicians and not so much for the "industry". Still, no one wants to get in trouble.
I work with a few indie musicians off and on for a pretty good rate. Perhaps you can find someone locally to score an original piece with different lengths, stingers, ins and outs, etc. That way you can piece together music that relects YOU as much as you like. They may also give you some good advice about sound design on location and during editing. I live near a film school and there are always lots of film students and editors who are looking to beef up their reel with projects that are very negotiable. You in turn give them something fresh for their reel. Just a thought. -- Tony |

3 CCC 24 P prosumer cameras. They cost a pretty penny but shoot in film quality. I would also recommend renting a crew with a camera try saving money.
-Plan and story board each shot. -Get a crew that knows what their doing. EDIT EDIT EDIT! Take a lessen from Blaine, use a good editer and make it into art! |

Hi Night have not seen you since the Menta-list went legs up.
I use a Cannon GL2 it's specs are good and it delivers broadcast quality vid. Sony Vegas for editing. It is non linear editing software. Pretty easy after a few weeks. Acid Music (Now owned by Sony) for music creation/production as well as playing and scoring my own real time compositions. Suggestion- Find a local band you like and ask to use their demo music on your project. Tell them you will give them credits in the vid. Most musicians I know who are not signed would not charge you. And be very flattered. Learn to do it all yourself. I did. It may take a couple of years but I can do what any other producer, director, editor can do as well as lighting and scoring. (In fact I have had a few offers to work in the field.). You can get decent sound from the camera I use. You can also buy a shot gun mike as Bryan suggested and then you will have -0- problems. Just hook it into the camera and you have pretty good digital sound. Or hire a sound man to nail the sound down for you. If you buy a LAV mike buy the best you can. I have heard many that sound like the guy is talking through a tissue paper mouth piece. But the good part is you can do all of the production at home if you have a decent computer and software. I do all of mine on a Dell laptop 1 gig ram and 60 gig hard drive with another 80 external. I have 4 externals for different projects. If you have any questions PM me and I will help any way I can. Best Wishes Jim PS Bryan like your site. I would aslo say very good information on this topic. I might suggest musicians freind . com for mics |

Hey Bryan, yes sorry, I did get your pm thanks very much for your help. I ended up going with the panasonic.
The music issue seems very confusing, I'll have to look into the laws and email some label companys and come up with something. Jack I might pm you about audio and aslo acid music. Thanks for all your advice. Also a little offtopic but, what forum have you been going to since the menta-list died? I tried the mental image but they are very hostile and argumentative.

I will be placing a banner ad on the Café' next week.
It will promote a couple of new things and also new forum/news letter. I was very disapionted Stuart, closed the thing after I drove several hundred over as an experiment here on the Café'. (But the experiment did work)! I thought the guy was a bit more than he was. (My mistake) I will be starting news letter. But it will be just that. Not a new product hype letter. Like the menta-list news letter has become. Well if I can be of help let me know. Look for the banner ad. Jack |

Would like to add that I am not saying Stuart is a bad guy.
In fact I like him and his work. We can all learn a good deal from him. It was and is a great list. You can still join and read the forum. The news letter is what I was commenting on. I realised after reading the post again that it might read as being edgy and that I was generaly slagging Stuart when it was the news letter that vexes me. But I readily admit one can learn from the news letter how to market effectivly. Just happens to drive me nuts. So once again sorry for any miss-understanding. Jack |
