I've found a wholesalers where I buy my balloons from that they sell Marvin's magic books as well. I was thinking of making this an extra for the b/day child in my more expensive show. Is it illegal or somehow against copyright to charge extra for these?

If you buy them and resell them that is what business is about. If you buy one then copy it and resell it then that is wrong and illegal, unless you got a release from the developer.

Make sure to check into a sale tax liscense if you start selling them after public shows and such.

Den is on target. You may buy and resell. There may be some licenses or sales taxes locally. That you have to check where you are. Buying and selling is just called "business" in America.

Thanks for the advice. one more question. I recently purchased the James Munton dvd, I was going to buy his instant auther system but was wondering what the copyright is on making my own. what am I allowed to put in it without breaching copyright. how has james got round this.

I'm not sure I understand your question. But perhaps this helps... If you buy my kit, you are allowed to customize and copy the book and sell as many as you like. You can make changes to the book - I actually make it easy for you to customize it with your name and advertising info. Obviously, you are not allowed to copy the kit and sell it to other magicians! I retain the original copyright to the artwork and the book contents, but you are in effect purchasing a license to reprint the whole thing for your own sales. It takes a lot of time and effort to create something and you should never copy other people's work unless they give you express permission. The tricks in my book are basically public domain tricks - like the 1089 trick and looking through your hand with a rolled up piece of paper. What I did was to spend the time researching tricks and stunts that were appropriate for the age group, write up the presentations and methods and get an artist to do the illustrations. I also spent a lot of time experimenting with page length, different printing options, and marketing methods. I also provide my telephone script which some of the smarter buyers have realized is worth the cost of the whole system! So the complete work is now my copyright. You can do all this yourself, or you can buy the ready-made kit with all the extras and save yourself a ton of time. It's up to you! My goodness, the circus and phone show guys have been doing the balloon pitch for years.
A couple of balloon, a small xerox of how to make a doggie and a whirlly balloon for a $1. A great source of extra income in the right situation. You could also let the parents know that the balloon kit is available as an added party favor for a nominal fee. Richard
