I was considering pumping a few different illusions out in the workshop and selling them through magic community sites such as MagicAuction or something like it...
I've thought about Square Circle... I've read countless threads on here of people asking about the tubes, etc. Why not make the whole thing and only ask a small price for it? Is this unethical? Is the Square Circle patented? I understand if I copy the look of (for example only) Owens or Abbotts design, I can see that being a problem... I would design my own design for the front... Any thoughts regarding this? (When I say mass-production, I only mean 15-25...) Bryan |

That is a good question that I too whould like to hear discussed, both by the folks who make their living selling props and by those who make their living using props in shows and the many people who have magic as a hobby and do a few shows a year.

Chance's ABC Gumball Re-Combobulator could technically be thought of as squared circle, but the whole effect is much better than the sum of its parts. It seem not only ethical, but necessary for the magic community to do the kind of work that Chance Wolf is. But where does one draw the line. What if in "Blow Yur Stack" a rat knocked over cups down by the docke instead of on a block a cheese. And the ending varied. Personally, I would think that was un-ethical an well, cheesy. But then a different trick with stacking cups with no rat would not seem as much of a rip-off. It would go by degrees and it would be subjective. I might think that a prop looks too much like Chance's work but others might not. How do we draw the line?

Great point! I would like to market to the "part-time performer." That's why I feel it would be great to offer a great illusion at a reasonable price...

But still which illusions are "public domain" and how much should your routine and props differ from someone else's marketed trick.

I would think that effects like the square circle,break-apart vanish, production boxes, would be public domain. You would have to do a copyright search to find out for sure. I do not know how to do the search but I have heard people talk about it.
Just my 2 cents Steven |
