Thank God this guy is being shown for what he is. People like Billy Wiz work too hard for people like James Fortune to rip off parts of his website. I’ve definitely seen this man at conventions and I can’t say I’ve spoke to him but I did notice the way he acts as if he was better than everyone else. Shame on you!

Hey Guys; For the record I do NOT regard James Fortune as a ‘low life beast’. A little misguided maybe… I gues we are all a little guilty of 'borrowing' phrase and gags from fellow performers. He who is without sin cast the first stone!
My main beef with James is that he didn't just 'borrow' one or two phrases (as lots of us do) but he literally copied and pasted the exact wording.... even the testimonials. When I telephoned him about his web site I adopted a very merry attitude; and even jested about “coincidences” etc. James’ reply was to the effect that he had always looked up to me as some kind of Guru in magic (Ha!). Hence he copied all of my wording as it was the best of all the others that he had looked at. He was very open about it; almost as though there was nothing wrong in his actions. I couldn’t believe what I was hearing as he took the wind out of my sails, so to speak. We left on very good terms, and that was that. When I cobbled together the wording for my web site (about 10yrs ago) I borrowed various phrases from books about using active verbs (instead of passive ones) and referred to many books on ‘How to Sell’ etc, and personalized them for me in the magic business. Life is too short to get into a fight, so I let the business with Mr Fortune go…….except for my little dig in Magic Café! I guess it’s similar with my trick; ‘Visible Magic Painting’. Almost every dealer in the world has copied MY invention from the late 1970s. But there is no point in getting upset… I’m just really pleased that it has given so much joy to the 1000s (maybe millions?) of kiddies all around the world. John |

The idea of someone copying a person's website word for word never entered my mind. I guess college trained me well regarding plagiarism. In the world outside of magic, word theft (plagiarism) is taken VERY seriously.
When I received my Master's degree in 2002, three people were expelled from my graduating class for plagiary in their final thesis. They lost every Master's level college credit they had "earned" for plagiarizing this one final paper. Stealing someone else's words is very serious and this single act cost them dearly. Tougher still: They are all responsible to pay for nearly $30,000 of student loans for a degree they never received. A severe lesson but they knew the rules. My advice is to copyright your website and all intellectual property (Your Original magic routines, original patter, etc.). Have an attorney drop a line to the offending party if your e-mails and calls go unanswered. Usually, no lawsuit is needed. Just a helpful hint from your lawyer.
Wonder is very necessary in life. When we're little kids, we're filled with wonder for the world - it's fascinating and miraculous. A lot of people lose that. They become cynical and jaded, especially in modern day society. Magic renews that wonder.

Late last year, James Fortune was shamed into changing his wording on his main web site, thanks to you guys. However, his other one, currently, still uses identical words to mine; see Duncan Trillo’s excellent, http://www.childrenspartyshows.co.uk/
Surrey. There, you will see identical words to my web site and furthermore, identical testimonials (but he changed his name from Uncle John to Uncle James). Copying someone's testamonials is really stupid! If what you say is true, John, surely, if any James' clients ever realise that his "testamonials" are actually for someone else, he could find yourself in deep water? I wonder just how he would deal with that situation? It would have been better for this guy to invent his own testamonials rather than copy someone else's.....in my opinion, this shows what a lazy and selfish attitude this guy has. No way he can have a show worth seeing, this dopey "performer" is a parasite. Folks on this forum often claim that poor performers have a negative impact on the whole performing market. Well, this kind of behaviour absolutely comes into that category.
Why not write a letter or two to his local papers, and quote some of the stolen testamonials? His actions are stupid above all, and most unscrupulous. |

Copying someone else's testimonials is the most ridiculous thing I've ever heard! James Fortune has a reputation for being a good children's entertainer, so why would he need to? Makes me wonder who's act he pinched in the first place!

I think the web has exposed a lot of people like James, what they forget is it's not just Joe public who'll visit their site, but curious magicians as well.
Both me and Billy have had our party tips pages copied by other people, Although with the party tips I don't mind, as long as they ask, and move the words around a bit so they're not a carbon copy.
