Every time I create a trick I worry. Did somebody create this first? Am I unintentionally ripping some one off?
So I thought what us honest magicians need is a sort of patent office with a label of originality. You know look for the Seal of Authenticity. Let put our brains to work and figure out how this could be done. Even if it goes no place it's good to exorcise the nugget without arguing.

There have been several threads discussing who owns what. One web site devoted to this is http://www.martinsmagic.com/fakers/magic-fakers.htm
It's a difficult task.

The "underground" works pretty well for the "authentication" side of things.
However, since magicdom sells its goods in the open market of muggledom... secrets quickly become property bought and sold, then gossip freely traded.
