Everyone should have a contract to cover the basics. Here is my basic contract.

PERFORMANCE AGREEMENT

Between PERFORMERS NAME , hereinafter referred to as the PERFORMER, and CLIENTS NAME hereinafter referred to as the SPONSOR, and dated this XXth day of MONTH, 2007.

The PERFORMER, in consideration of PRICE dollars ($X.00) to be paid by the SPONSOR in the manner hereinafter described, agrees to provide the following magic performance.

DESCRIPTION OF SERVICES: XXXXXXXXXXXXXXXXXX
LOCATION OF SHOW: XXXXXXXXXXXXXX
PERFORMANCE DATE: XXXXXXXXXXXXX
PERFORMANCE LENGTH: XX minutes
SHOW TIME: XXXXXXX
EVENT/GROUP: XXXXXXXXXXXXXX

It is expressly understood that the PERFORMER is an independent contractor, that he is not an employee of the SPONSOR, and that the PERFORMER is responsible for the payment of all applicable taxes on the consideration received for his services. The PERFORMER shall have the exclusive control over the means, method and details of fulfilling his obligation under this agreement except for the performance time and the length of the act.

It is understood that the performance is an audience participation program, and that unless specific arrangements are made to the contrary, the actual length of the performance may vary from show to show by a period no to exceed ten (10) minutes.

The SPONSOR agrees to pay the PERFORMER a deposit of fifty percent (50%) of total performance fee to secure the above performance date. Remaining balance due at the conclusion of the performance on the above stated date. If the magic performance is cancelled or postponed for any reason by, or on behalf of, SPONSOR, the SPONSOR will still be liable for payment in full (100%) of the consideration provided for herein. In such event, SPONSOR will make this payment to PERFORMER within ten (10) days following the date of the scheduled performance.
This agreement shall be interpreted and enforceable under the laws of the state of XXXXXXX.
