Re the Zig Zag lady. The owners of the book were given full rights to build or have built one for their own use. in addition to that, the first authorised version was built by Owen magic for Blackstone Jr. Having worked for Owen for a while, I can definatly say that they were authorised to build the illusion and that they did send a royalty to Robert Harbin for each one built. as for the illusion, the original one was built differently from every one that was built later. RH's version had a continous strip along the top of the center section to hold it together. the assistant had to duck under that strip to enter the box. everyone that followed successfully removed that section and the boxes were totaly stable and held together well. (even the first knock off copy by Summers had the strip removed). A little known fact(taught to me by RH himself at Gaughans studio) was about the presentation of the illusion. it is a divided girl illusion---the slide out of the center section was only to prove that the girl was really cut into sections. most make a "big deal" about sliding it over a little at a time etc. Another thing that no one seems to know about (except the owners of the book and RH himself) is that it is a close up illusion (in the book 13 pages were devoted to the illusion----AND IT's PRESENTATION. When Harbin did it, he had an audience member up on the stage with him to examine the box and watch it close up.
as for the Osborn plans---they came out after a zzg was purchased from Owen magic(as did several other illusion plans) they also are an exact copy dimension by dimension of the Owen model. Paul |

BTW, Jim Sommers was the first person to knock off the Zig-Zag. Ordinarily, I wouldn't say this so bluntly, but the whole case was detailed in the Linking Ring when it happened. Jim adamantly claimed simultaneous invention until he was pressed for information. I wish there were some way for the major magic societies to police this kind of thing. There were two competitors at the IBM-SAM convention in Louisville who used material they did not have permission to use. They should have been eliminated from the competition immediately.

As for the "Zig-Zag" itself, the terms set forth in the Harbin book could be - at best - defined as a "contract of adhesion", and were never legally binding. Many, many builders - including myself - have constructed "Zig-Zags" over the decades since it was first introduced. In my own defense, when I built my versions I had no knowledge of Robert Harbin; the basic design and rough measurements I got directly from John Pomeroy (in Seattle), and he never told me the origins of the prop. Virtually every known and respected prop builder has built a "Zig-Zag" or two, and (as mentioned above) the plans are currently available from Paul Osborne. [End quote] Can you tell me which page of the Harbin book the release to build the Zig-Zag was on?

If there was a single release for the Zig-zag, there would have had to have been one for each of the other illusions. I never saw one, and this is the first I have heard about it. Perhaps it was mentioned as part of Harbin's letter that went with each book?

The grant of rights, which is set forth at the beginning of the book and was also sent as a separate document to the original purchaser, pertains to the construction of the props for all of the effects contained in the book. |

The idea that contracts of adhesion aren't binding might have had some life for a few years half a century ago; but you are likely bound to adhesion contracts on a daily basis, and the circumstances around the Harbin book would have made a challenge on adhesion grounds as guile as challenging an adhesive consumer contract is today.
