Here's an ironic thing, by issuing a patent for Flying, the illusion IS exposed! It's available for free by anyone who wants to look at it. Google Copperfield's Flying secret and it's there. When something is patented, the only thing that does is gives you legal leverage to sue. But what you may not realize is lawsuits are VERY expensive. It's not $5,000 and it's over. It can literally cost hundreds of thousands of dollars that the person doing the suing has to come out of pocket with. AND, if you win, that's only half the battle. Just because you win doesn't mean you're going to collect and it can take years to collect. $28,000,000? hmmm. Does The Mask Magician have that much? I didn't think so. So there's a judgment against him another country that will NEVER be paid. Aside from the fact that just because a purchaser of an effect signed what might be a legal document, doesn't mean the person DOING the exposure did. After you've been at this a while, it's easy enough to figure out the method on your own and duplicate it for an exposure show. |

Can I just point out that secrecy patents, such as the ones Peter Marvey uses for his flying last a lifetime, unlike traditional patents, and cannot be legally duplicated.
There is a reason no one has exposed his work. Alone won't be exposed either for example, as the TV performance rights are withheld on it; and you cannot perform it on air without them. Edit: The Masked Magician didn't have to pay it, the TV company did.

Again, patents don't provide protection. They only provide you an avenue to pursue legal action.
I wonder if the production company for the masked magician did pay. I'd love to read about it rather than just a mention here. If there are links, please pass them along! |

I know there is nothing that can be done to stop the show (like the Masked Magician) only bad ratings, so better hope the show is really really terrible. Stuart |

I did find this article which shows the masked magician was sued in 2003:

I couldn't find any mention of that or how much was won. Now that's Brazil. Here in the States a case can drag on for even more years. The point is, it's doubtful anyone would win, aside from the lawyers! So we sue this guy, and we're already going after all the rapidshare & torrent guys, does anyone have time to perform? |

Some Dutch mentalist that were interviewed told the reported that they think it´s scandalous and that it hurts creators who spend years of developing these tricks most. Richard Stooker is on the phone and tells he is hiding because he received so many angry phone calls and threats, and that he doesn´t want to harm anyone in person, he said it´s a positive promotion for mentalism??? So he is playing innocent… John |

Ok, here is a translation...
(I hope it's English ) Thanks for your email. I can understand your reaction en I’m glad you’re more moderate then 90% of the other colleagues. I can’t say too much due to contractobligations towards the producer. To my opinion the show is PR for the trade, but a controversial way of PR. Since 1,5 years there are rumours about dutch or foreign producers wanting to make a “Mentalists Exposed”. I also know that several mentalists/magicians are contacted. I don’t know their decisions and/or working actvities and I don’t need to know. I made this show/format for a number of reasons with “Protection of the trade” in mind. Some things I was able to demand, with other things I had to make concessions, but I think my body of thought is still standing. Allthough the title gives an other idea, I think it will turn out to be positive for the Dutch Magic-society. We worked with the best people in the dutch media, and a lot of money is involved. Never before a magic show on dutch television was so expensive. Camerapeople, director, people behind the scenes,….. everybody had knowledge of magic en put his/her energy in the development of the show. I’m proud I was able to work with them. The tricks/effects in the trailers are not all explained (obviously). This is not how the show was intented. Officially there will be explanation of effects, effects that will not be explained and a piece of history of mentalism per episode. Unfortunately the history-part had to make way, because the station (RTL5) wanted to uplift the speed, but this will return on the website. Mentalism should not be stigmatised to be “occult”, “special gifted”and/or cheap children-entertainment. Mentalism belongs in the theatre, on parties, special occasions and even on TV. For the last two years it’s heading the wrong way. We understand that it must be a “trick”, but many (hundreds of) thousands people believe that there are powers in play. The protests against the show of Rob&Emiel (famous Dutch mentalists) with Uri are the low in this. Entertainment? Yes! Clever? Yes! Special? Yes! Gifted? No! Occult? No! I always thought different in Magic, but the passion isn’t less then with other colleagues. How do you convince your audience? Certainly not by saying: “I won’t tell!” Futhermore the reactions go very far,… The biggest mouths state on their website that they give workshops and explain tricks/effects. Is that Ok, then? What’s the essential difference between the show (made by PRO’s) or on location in front of 300 people. To my opinion the only difference is the size of the audience. Everybody is talking about me taking the bread out the mentalists mouth. But what if it turns out to go the other way and lots of bookings come in, because the audience wants to see mentalists live? Will they pay me 25% per booking per performer? History shows that (look at Hans Kazan (dutch magician), Magicians Exposed and even Houdini, who questioned “special gifts” with photography) that the (magic)art has become more professional. That is why I don’t share the thought about the “bread and mouth”. History also taught us that there always were complaints and threats, but never a “thank you” when it turned out that the art became more popular. Have you noticed how many times he mentions 'money' or such in that email? He really seems obsessed by it.
"Will they pay me 25% per booking per performer?" No, but you may be sued for taking the bread out of their mouths, and hopefully you will be. People do not claim it is occult and haven't for a long time.

INTERNATIONAL MAGIC ALERT The Dutch Association of Magicians (NMU), official member of the FISM (Fédération Internationale des Sociétés Magiques), herewith informs all Magic dealers and worldwide magicians that television station RTL5 (Dutch language; http://www.rtl.nl) intends to broadcast the exposure of magic secrets. Name of the programme is 'Mentalisten Ontmaskerd' (‘Mentalists Exposed’), to be broadcast in a series of six weekly episodes, starting as of Sunday 18th of April 2010, from 20.00 - 20.30h. A Dutch magician, Richard Stooker, has announced to explain the secrets of mentalists. His justification is to warn the world for the dangers mentalists may cause. In fact it concerns the exposure of mental magic secrets. However, mental magic is one of the officially recognised categories within the field of magic. Initially Mr. Stooker was announced to perform under the cover name of Ti Ta Tovenaar. On April 14th, media reported that this name is already owned by others than the producer of the programme. The producer will most likely be forced to make changes. However, the programme has not yet been cancelled. Previews of the programme have suggested that the following effects might be explained: - exploding light bulb - floating table - a Russian roulette with guns - a PK routine with a compass - pk touches - airborne - an acid roulette - floating cane - bank night - magic square - Russian roulette with a knive The following effects have already been explained in previews: - Bending spoon. Effect clearly explained in Dutch language. The secret looks very much like the exclusive TENYO version with the spring mechanism. - Floating ball. Effect explained with finger tip gimmick. or at least will send Richard Stooker into exile. Please think about before watching any youtube video of him. you will help rating it higher and make it more available for laypeople.
