Having read a lot recently on the Café about the inability to protect magical inventions/secrets from TV exposure I was wondering if there is any mileage in how game shows protect their intellectual property.
Looking at all of the brands such as Pop Idol, X Factor, X got talent, etc. People like Simon Cowell 'license' these brands all over the world. Does any Café member know how it is possible for Cowell to 'license' a show to prevent others stealing the idea in other countries? Perhaps the magic community can use the same mechanism to protect their televised magic. |

You can't copyright or trademark an idea, so anyone could produce a reality competition show involving singers.
You can, however, trademark and/or copyright most of the elements that are specific to your expression of the idea; e.g., format, scripts, set design, etc. Interestingly, you can't copyright the title (at least not in the US), but that doesn't mean you can't stop someone from using the title for a different expression of the underlying idea. Licensing the format of successful reality shows to foreign markets is very big business. |
