Assuming the guy has a problem and should be prosecuted for assaulting women, what's up with the "sodomy" charge? It's not enough to charge one with assault: the particular form of sexual activity (one which probably 99.99% of the heterosexuals on this forum has engaged in) is "criminal".
Do we keep these ancient laws on the books so that when we "throw the book" at somebody, it's a really really big book? Why else keep such laws? And I'm completely serious. It seems to me there is no other purpose for the law against "sodomy" other than to add it to other charges to ensure we get the bad guy behind bars. (Although in this case I'd bet a pretty large chunk of money that he won't get a prison sentence.) |

The European Union says the scandal surrounding Mr Strauss-Kahn should not affect bail-outs for eurozone countries. Oh well that's good news, it will not affect the raping of Europe.

I remember hearing about undercover stings in Idaho to try and catch the "sodomites." Practically everything sexual was illegal in Idaho. The word does make for a more sensational headline.

He was indeed charged with "forcible sodomy". The statute explicitly refers to "deviate sexual intercourse", and comes from 2001:

Balducci, I'm not a lawyer either, but I know how to read aq well as you do. Yes, it is clear that this is not a statute against consensual "deviate sexual intercourse". I got that.
And I realize that "deviant" does not have to necessarily be pejorative. If elsewhere in the law intercourse is defined strictly as penile/vaginal, then there needs to be an explicit reference to other forms of sexual assault in the naw, and the word "deviant" (as in, it deviates from penile/vaginal activity) is precise enough. Having said that, the word "deviant" is usually pejorative in the English language, as is the word "sodomy". I'm a bit surprised that you don't get this point; I usually find myself on the side of the Canadians in these debates about tolerance and sensitivity. Being charged, literally, with "Sodomy First Degree", has a ring to it that can be falsely interpreted--just as I did before actually reading the law. How many normal citizens go and read the law? It was not the article that was misleading, but the title of the statue in the complaint. And if you don't accept that the word "sodomy" is pejorative, try using it earnestly in a sentence without getting a goofy smile on your face, such as: "last night my wife and I...." See what I mean? Again, I'm surprised at the difference of perspective. Maybe a lawyer (are there any regulars on the board who are lawyers besides Lobo) could chime in and set me straight. It could be that "sodomy" is simply an entrenched legal term because of its use in the common law. |

I just noticed in the link that it says "former crimes". This must be an outdated statute. I suppose that I indeed cannot read as well as Balducci can, and I certainly am not as good with Google as he is. My apologies. For those who want to read (or mis-read) it all for themselves, the filed complaint is here: http://www.thesmokinggun.com/file/strauss-kahn-complaint (I Googled the statue numbers in the complaint and came up with an old law.) The proper names of the laws are actually written in the complaint, and the proper link to read the statutes is this one: http://ypdcrime.com/penal.law/article130.htm Please note that the words "sodomy" and "deviant sexual intercourse" no longer exist in the relevant statutes.
