Furthermore Mcdonalds was well aware of the situation. During discovery, McDonalds produced documents showing more than 700 claims by people burned by its coffee between 1982 and 1992. Some claims involved third-degree burns substantially similar to Liebecks. This history documented McDonalds' knowledge about the extent and nature of this hazard. thus they new about the dangers involved with their product but did nothing to correct them.

Aye - in that case - there really is no question of McD's guilt.

As noted above, in this particular issue, if the cup/lid were faulty and/or unable to contain the coffee properly and it resulted in injury (which DOES appear to be the case) then they are and should be liable.

It should also be noted that McDonald's own research showed that their drive-up customers generally intended to drink the coffee in the car, and NOT when they got to their final destination (as McDonald's claimed in court). But, despite that, it was shown that the coffee, upon delivery, was hot enough to cause burns to the tongue and throat. (Let alone to the groin, where this poor woman was injured when the problem of the overly hot coffee was exacerbated by the damage it caused to the styrofoam cup.)

I'm still quite curious as to why McD kept the coffee so hot. What motivated them to do so?
Here it is suggested that it was to prevent customers from drinking it right away in the restaurant so as to lessen the number of refills they had to give out. http://www.legal-news-california.tozerla......ase.html My question would then be, why not just NOT do the refills? I'm not certain if this is a real reason or not, I'm still quite curious about it.

Two wild guesses, I have no idea if either is the case:
1) Some kind of consumer research showed that customers want to see steam rising from the coffee cup to prove that it was hot and "fresh." or, 2) There is something in their coffee making process that required that temp in order to get the maximum usage from their ground coffee.

Things have obviously changed with McCafe's and free WiFi but I think McDonalds, in past years, did not want to keep people instore.
In the late 80's when I was poverty stricken, I betrayed all my ethics to teach kids to be clowns and entertain tykes at birthday parties for Maccas main Australian competitor. I was told McDonalds wanted to get their customers in and out quick, so they used bright garish colours to lure them in, but these colours also worked to drive them out, as did the small, narrow uncomfortable furniture they installed. The mob I worked for used warmer earthier tones, plastic plants, and more comfortable furniture to hold their customers longer. |
