I'm not sure if getting charged with something that is quickly dismissed necessarily constitutes a miscarriage of justice. Now, if there had been any actual consequences ...

I agree, rockwall. It would only be a miscarriage of justice if he was convicted and sent to jail.

While that's not exactly what I said, I'm glad you agree.
Although Justin has not been convicted, he did spend 8 months in jail and suffered some pretty serious consequences and I suspect is still suffering from the threat of severe consequences. Emotionally, I suspect that threat hanging over him continues to be devastating. |

The continued arrest of people who do nothing wrong for a clearly political reason is harassment and is especially egregious in the instances when people are expressing their first amendment rights. And what happened to Justin is absolutely wrong as well. To my mind, they are both examples of law enforcement officials not understanding (or not caring about) the Constitution.

So, it's been over 2 years since Justin Carter was arrested for making a sarcastic comment on facebook regarding a video game he was playing. You might be amazed to know that it still hasn't gone to trial and that Justin has essentially been under house arrest for the last two years. More here.

Given what has transpired, I hereby withdraw my nitpick about the term "miscarriage of justice."
Who is this kid's lawyer? Why hasn't there been a demand for speedy trial and, prior to his delayed release on bail, a petition for habeas corpus? And, considering that his current situation is equivalent to house arrest, habeas may still be a remedy. Were I still practicing defense law, I'd defend this kid pro bono. What's next? Is Jeff Dunham subject to arrest when his "dead terrorist" ventriloquist figure says, "I will keel you!" and a sensitive audience member becomes "concerned" because there are children in the audience? Why hasn't the same DA filed charges against the likes of Ted Nugent, for example? He got away with a simple visit from the Secret Service. |
