Interesting that you wrote "I am glad that Al did a knock off of the pea too". I think the issue with us protestors is that the scarab beetle and dung ball are such a unique idea that Al infringement on Frank's market upsets us. There are lots of bugs to make shells about, why go head-to-head with a fellow magician like that.
If an entomologist magician wants a certain product desgn made, great. But why market the product to everyone else unless you want to capitalize on the popularity of Frank's idea. As I said there are lots of other bugs (even beetles) to choose from if one sincerely desires a bug in his product line. I remain skeptical. |

Haven't been on here in a while and just saw this thread.
I would like to thank all of you who are sticking up for me and my products! I have been ripped by companies that took my products and had them reproduced in India and China. So far my magical creation have not been copied overseas ,just here in the USA. TAKING MY SHELLS AND CASTING THEM IN METAL IS A COPY RIGHT INFRINGEMENT. Al does have a right to create his own version and I am flattered that he used my design as an inspiration for his shells. I have been making some of these shells for over 15 years and I am about to release a couple more sets soon, (Pocket crabs, pocket scarabs and my twist on the bottle caps). From what I can see of Al's products, they look pretty cool and his bottom lip is an interesting idea. I tend to be a traditionalist when it comes to magic. Tricks that look gimmicked, I would never use. Al started with cyber mouse, which was a cool idea. But, taking my idea and making something similar in outward appearances is wrong. Is he going to make a turtle shell version next and would that be ok? No it wouldn't be........ Maybe I should do some sets with a lip, would that be ok? Had to put my 2cents in since this argument is about ethics. Thanks again for the support, Frank Black Fox Ps. Nice job Al.... |

Frank, maybe you should start making Monte Disks.

Bri from cupsandballsmagic designed the Cyber mouse shells, which was a cool idea.
I made the 3 blind mice, that I had made in my own collection over 20 years ago, as well as beetles, turtles, lady bugs and many other theme type shells. I have many different kinds of shells that I haven't even put on my site yet. It is not rocket science to think of these things. I bet there are others that have thought of these as shells. Black Fox was the first to sell scarab beetle shells. That does not mean, he or I was the first to think of them as a theme shell. I have been making different kinds of shells over 25 yrs. for myself and some friends. I just started making shells to sell a few years ago and have hundreds of shell molds from over this time period. It is easy to think of different kinds of theme shells. The hard part is designing a shell with better functions. The only thing I can really say for sure that was a original design was the Bottom Ridge on my shells. This is only because there was a full patent search done and it has never been used for any game or for the function it does. Even the shells I make without the ridge are designed different than the standard type shell. All of my shells came from my own thinking. I think we both make a nice Scarab beetle shell. I enjoy designing shells. I would never copy any ones design. That would be wrong and no fun at all!!! The only thing Black Fox shells have in common with mine is that they are a beetle, otherwise they are completely different in appearance, design in function and different accessories. Good luck to us both.

That you believe you're doing nothing wrong has already been established earlier in the thread.
That others believe you're unethical in some of your efforts has already been established earlier in the thread. You've taken this opportunity to repeat that you think you're doing nothing unethical. Others continue to believe that you're fundamentally unethical in copying Black Fox's original Scarab Beetle shell design. |

I didn't see anybody addressing you benhart, so it's difficult to figure out why you felt obliged to reply in such a personal fashion?
As an aside, I'm going to guess ... and this is only a guess, but I'm going to guess that your job doesn't depend at all on your ability to express yourself in words such that you're obliged to make any sense, or sound at all intelligent? |

Shellgame-Al has made a number of great products and has provided some excellent products for us lot. From the products I've seen, and having personally bought his items, he takes a lot of pride in his creations.
He is NOT getting rich and he is NOT out there to rip anyone off. I admire the craftmanship and thought that has gone into his products. As for the whole ethical thing...Vernon once mentioned to a mate of mine that if as a magician you truly invent one thing in your life you've done really good. If you invent 2 things, you are a great magician. Nobodies ever invented 3 things. He said he invented 2 and was working on his third thing but.....just found out last week that the first thing he invented had been done previous to him....So he was back to only being a good magician. (said with a smile) . |
