Question regarding effects that use old photos.....
Are these photos that you might find in an effect such as Till death do us part or things like that, simply found with a google image search or are there rights issues involved at all. I would think not as they are so old, but just something I wanted to ask, As I've an idea in the works, not a new effect but a routine using photos |

Even though the images are old, the digitization process can create additional copyrights. So it depends where you source the photos from. Some photos do have a copyright permissions issue, some do not. It would be better to use the Google search only to track an image back to it's origins to see if it is usable, and not just use the Google results.
Also, it is important that if you are claiming they are from a certain era, that you use photos only from that era. Amateur photographers are likely able to identify incongruities with your story and the image type/clothing worn in the pictures. Even when digitized and printed, there can be some noticeable differences between Daguerreotypes, tintypes, etc. All the best, Brad |

Creative Commons search has the ability to specify what kind of rights apply to the photos. You can search for royalty free, available for commercial use, available for editing, etc.
Personally I just search the local antique stores for cabinet photos. Here in Southern PA they will have stacks and stacks of them, often for .10 to .25 each. Maybe as high as a dollar for the really nice ones. I definitely agree with Brad above - make sure the photos are actually from the correct time period, and reflect the story you are telling. Anyone who's even passingly familiar with such things will immediately be able to tell the difference.

Just to be clear, if it's for personal use only then there's not much to worry about.
Only when you offer a routine for sale to the public do these be come concerns.

I don't think it's an issue since you wouldn't be selling anything. The issues come up when you would be directly profiting from another's copyrighted materials.

Oh and just to be clear most pics posted online are in the public domain. At least the ones at the link I posted are.

Ok cool, thanks all, I was just concerned about collecting the images I need for the effect-which will all be Victorian era type - that some one might see it and say, hey that's my great great granny or something
