You receive a damaged product that you are not happy with, why on Earth would you not simply return this for a refund?
For whatever its worth, he did send me a pic and I replied with a quick video I filmed for him and suggestions on how to fix it

Just following up on my earlier post. I had initially received two defective units. I took the advice posted earlier in the thread, and sent them to Mr. Mason. In less than a week, I received two replacements. One is still in the box, however the other one appears to be working fine. At times I can feel some contact when going up and down, but it isn't causing a problem.
I have to respectfully disagree with the "mile off" comment that was posted earlier. In my opinion, the gimmicked part is hidden very well, and it is mostly transparent.
I like the unit. I think this will be fun.

You should 100% return for a refund or replacement at least!
Mine was sticking, and Mark Mason replaced it no problem. You are obviously not happy with it overall, but for it to be defective is reason alone for a refund/replacement.
Where did you purchase it? Have you tried contacting them?

My wife bought me this for Christmas, I was pretty excited except my gimmick has been jamming non-stop making it unusable.
I've emailed Mark for guidance, as it was bought from a local magic shop here in Vancouver, so we'll see what he says. Will keep you all posted.

Did you see the video I sent you along with my message for tips on how to fix your unit? I have previously acknowledged there were some faulty units in the first batch - I encourage you to try my suggestions or reach out to Mark for a replacement that functions as intended instead of keeping the faulty unit and bashing it.

Yes I did receive your email on how to repair my gimmick but sadly running a black sharpie round it will not make this piece of crap any more effective

Cardbiker, I don't own this but I'm curious why you are so intent on bashing this item before even attempting to replace it. David has been forthright about acknowledging there was a batch of bad units released initially. It sounds like you very likely received one of those and I'm not sure how you could be certain you didn't. Stuff happens.
Doesn't seem like you have contacted Mark Mason or your dealer about replacing it.
By continually bashing what very well may just be a lemon and not representative of the typical product as if every unit is like that is unfair to say the least.
Seems like you may possibly have another agenda here.

Update: Mark responded right away and shipped out a replacement for me that same day. It arrived yesterday and the gimmick is much more smooth and reliable. It also looks less conspicuous than the previous one as the material matches better.
They clearly had a bad batch but are standing behind their product and care about their reputation, if my single experience means anything.
