Did anyone do sign up? Party City has allot of traffic in their stores so maybe this could grab some business for some performers this would be a good match if you do home parties as their customers are probably always asking if they know entertainers. It is the name that gives this some credibility.
I just received the solicitation from them in 2019. As the OP, read the terms and they still omit the commission rate so it was good to read as I do not think they should be hiding this. If it is still 20% that is high for lead generation but why not have just charge more so any gigs that do come through you do not feel compromised.? "Cancellation/Rescheduling Policies for Consumer: We allow a Consumer to cancel without penalty 15 or more days before the scheduled date of a booked party by calling 1-833-KAZZAM1. After that time, to the extent the Consumer cancels a party, cancellation fees will apply based on how close the date of the party is to the date of cancellation, unless you and the Consumer mutually agree to the cancellation by calling 1-833-KAZZAM1. Below is a table setting forth such cancellation fees: Days to Party at Time of Cancellation % of Party Cost Charged as Cancellation Fee 15 or more days No cancellation fee 8 to 14 days 25% 4 to 7 days 50% < 4 days 100% Upon cancellation by a Consumer, all amounts, other than the applicable cancellation fee, will be refunded to the Consumer. Kazzam will retain its pro rata portion of the cancellation fee (based on the commission for the service) and the balance of the cancellation fee will be remitted to you and the other Party Service Providers, if any, on a pro rata basis. In the case of a cancellation by mutual consent of the Consumer and the Party Service Providers, all amounts will be refunded to the Consumer." For me, two weeks is not enough time to let consumer off without paying something. IT does not appear they collect a deposit or at least they do not pay the performer until after completion. "As a Party Service Provider, after you agree to support an order, either by emailing us or confirming with a Kazzam representative, you are responsible for promptly ensuring that the taxes you previously set, that will be applied to the booking, are correct. After that time, you will not be permitted to cancel the booking after confirmation without penalty, unless the Consumer consents in advance to such cancellation. The following penalties apply to the Party Service Provider for cancellations in any rolling six (6) month period: Number of Cancellations in a Rolling 6-Month Period Maximum Monetary Penalty 1 Lesser of $100 and 50% of booking charge 2 Lesser of $250 and 75% of booking charge and possible removal from the Kazzam Platform 3 Automatic permanent removal from the Kazzam Platform At any time, Kazzam may, in its sole discretion, whether or not as a result of the number of cancellations by a Party Service Provider, suspend or revoke your right to list on the Kazzam Platform. A Party Service Provider’s failure to appear for a confirmed party without cancelling will result in automatic removal from the Kazzam Platform in addition to any claims by the Consumer." So my confusion is they want to charge me if I cancel ones in ANY time frame but they let the consumer off? It does state that if the consumer agrees there will not e a fee but do not say if that is in any time period. |

What are so worried about canceling? I've never missed or canceled a show in 43 years. Not a great concern of you have the right contact with the client.

You are also required to add them to your liability insurance. Depending on your company,that could either cost you or maybe be a hassle if you had to add them each gig.
" As a Party Service Provider, you are responsible for having reasonable and appropriate liability insurance in light of the nature of your business and agree that you will have Kazzam, LLC named as an additional insured." I use IBM insurance They charge $35 per period so if you can add them at the the start of your policy then that would be a minor fee per year since you do not have to pay Kazzam a membership fee. All of this seems to be pretty in line with entertainment industry standards. 20% lead generation, booking fees, commissions, referrals, etc. The insurance is also quite standard in most professional markets. Most insurance companies do not charge for this (as you said I guess then IBM does) and have an unlimited amount of additionally insureds. Many clients/purchasers want this as well, again pretty standard industry stuff.
What I can't seem to understand for those that have a problem with this is why complain? If it's not for you, don't sign up - pretty simple. It could be another source of lead gen for a performer. Again, as most here know, success (and the actual profit) is in the follow-up, so once again, if you aren't going to do this or it isn't for you just pass on it. Look at their targets and demo. They are providing a service, you can either take it or not. I would contend that you probably already know the type of bookings you would get from them as it seems pretty much like a consumer market resource, doesn't it? |

You should know what you are getting into Mindpro.
Like they can use your content to sell there service but do not have to link to you. "By making available any content on or through the Kazzam Platform, you hereby grant to Kazzam a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such content on, through, by means of or to promote, market or advertise the Kazzam Platform or the services, or for any other purpose in Kazzam’s sole discretion, except that private messaging through the Kazzam Platform will not be used by Kazzam in public advertising. The license you grant to Kazzam shall survive termination of your Agreement with Kazzam and your use of the Kazzam Platform or services from Kazzam. Kazzam does not claim ownership rights in content that you create. Nothing in this Agreement will be deemed to restrict rights that you may have to use and exploit any such content that you submit, post, upload, publish, or transmit on or through the Kazzam Platform." and they can edit your content. "You agree that Kazzam may edit and/or withdraw your content, and you understand it remains your sole responsibility to monitor your content and ensure that such edited content is accurate and consistent with your representations and warranties in this Agreement." While some of this is industry popular (sorry Mindpro 20 % is NOT common on the E-booking sites) One should be aware what you are agreeing to. Maybe they will only edit content if you add something against policy but it also give them to leeway to edit your content without warning or reason. And again Mindpro. Gigmasters and Gig salad do NOT require you have insurance nor do they require you put their name on YOUR insurnace. It depends on the client, but some ask for this but many do not. It depends if you are more corporate, large group like schools or say towns. But not all ask for it and I would say in my area, only a few ask to be additional insured every year. Most just want to know I am insured and see the policy. I am still curious if anyone signed up and how it is working? |

I agree you should, of course, know what you are getting into and what you are signing before doing so or accepting such agreements. However, these are not E-booking sites. These are lead generation sites. They do not book or represent you, they simply put your information to the prospective inquiries that match your listing elements.
They make a fee on anything booked as a result of the lead through a fee paid by either the performer or the purchaser. They make additional fees from advertising listing packages/memberships, and for additional services like payment collection and processing, but these are not agencies or booking services. If anything they are matchmakers. No GM or GS does not require proof of additionally insured but many of the booking clients do. By the hosting company requiring it is a way to ensure that they can say and advertise all members carry such insurance and coverage. Mark my words, they will be creating a revolving door of performers many of which will not likely stay with them longterm. I could be wrong, but I know a lot more about this arrangement than most as I was involved in an earlier attempted version of this arrangement. Yes, it is a bit excessive as compared to GM and GS but I think that is intentional, but I still have doubts that it will be as great and prominent as they are projecting it to be. I am involved in a similar service for high-end professional markets, venues, and targets, and have a good understanding of what they are hoping to accomplish here. Time will tell relatively soon. I think of Party-Pop, and others that came on strong only to have faded significantly. I never said GM, GS or these other lead generation or matchmaker services charge 20%, I said it is an industry standard for booking commissions, referral fees, and a fair standard of a typical cost of a new customer acquisition. They seem to be using a lot of CYA provisions likely due to some knowledge of their process or future use concerns. I have coached several contestants on America's Got Talent and trust me you must sign over a lot more of yourself to them than what is stated in this agreement. It certainly is not for everyone. I agree this should be a concern with any performer, especially from a newer, unproven entity with such likely low-end consumer event targets. This does probably seem excessive (and likely is) for those only used to working the consumer market. |

Sorry I disagree I have been a long time participant of GS and GM. "MANY" do NOT ask for me to add them to my insurance. I disagree that 20% is a common agent fee. 15% is and even if they are more, a real agent will WORK for their fee. They will promote talent. They go on getting you the most they can get both parties so they make more commission. The on line folk are NOT earning what they expect to get. If a live agent is putting in time they are actually working to get a higher price tag rather than find the one who can do the gig for the least so they can make as much as they can for themselves (that is a "booker"and is not a real agent)
Anyway, It has been over a weak , they still send me emails but have not sent me a direct response to the current commission nor do they reveal their fees in their service and terms and that is a bit suspect. |

Yeah, he does. He obviously hasn't read my book on Agents and Agencies, lol. The problem is once someone gets and accepts wrong information in their mind, everything built upon that is also likely wrong or incorrect too. It's always been funny to me how guys will fight to defend their beliefs in incorrect information - even when speaking to longtime agents, lol.
