Becareful of your rubberband magic, you would not want to be charged with asault in Florida schools.
I kid you not... |

ARGH! It's a freaking rubberband! Next nobody will be using pens or pencils in schools anymore because you could stab someone with them...

Actually, there's a big 'no rubberband' thing at our school. They're just not allowed. I thing it's kind of an odd rule myself, but that's why I don't use them in school anymore...

Bomb threats, explosives, arson, and...assault with a rubberband. Seem fairly comparable to me. If the teacher then kicked the student after this deadly assault, it would be self-defense, right?

Well, I guess I should stop popping the gaurd at the bank I work at with a rubberband --- I might face the death penalty.

I'll say this. I'm am not for all this touchy feely stuff and zero tolerance garbage. BUT all we have is this side of the story. The student says the teacher asked for the band and he "put it on her desk". Fine, that's what he says. But what if the kid was screwing around with the band, the teacher said "give that to me" and the kid, acting like a little punk pulled it back on his finger and shot it at the teacher hitting her in the face?
I'm not saying the kid should be expelled. But if he was acting like a little punk and now Mommy is running to the paper with her sob story, I saw screw em'. I would like to know more about this kid, his attitude in school and what the teacher has to say. Vandy

No doubt, but unfortunalely with a lot of zero tolerance stuff and actually documenting "levels" of infraction the school boards sometimes paint themselves in to ridiculous corners. Then instead of using common sense to dole out punishment and discipline they have to refer to these stupid rules that have been layed out. Then they say "well our hands are tied, theres nothing we can do. A level 4 offence calls for expulsion and that's that." I don't believe that this kid simply walked up and "put the band on her desk" I believe he shot it her and now the school has no choice but to try and apply the silly rules thay have devised. The rules should probably not have been made. But administrators are having more and more difficultly using common sense and meting out proper punishment. It's really kind of a cop out in my opinion. I bet that if this poor little boy got his eye accidentally snapped by a rubberband, his mother would quickly be on the phone with a personal injury lawyer discussing how to sue the teacher for a million bucks for carelessly allowing students to play with 'dangerous' objects in class.

MJ,
That wouldn't surprise me, but stopping a kid from playing with a rubberband and suspending him for doing that are two different matters in my view. Of course we don't know the full story so we don't know exactly what the kid was doing with the rubberband (shooting it at the teacher's face?). I suspect that, as Vandy mentioned, this was a zero tolerance matter and the school wasn't permitted to exercise judgement in meting out punishment, parroting a much larger problem (in my view) with the draconian U.S. Federal criminal mandatory minimum sentencing requirements that have stripped judges of their ability to use judgement (not that I have an opinion on the matter ). I too belive that the spoiled jerk shot the rubber band to her desk, but all common sense seems to have been tossed asside.
Zero tolerance causes many more problems than it solves. Look at the fourth graders ARRESTED by POLICE for playing cops and robbers and pointing their FINGERS at each other like guns............. And on the other hand a teacher in California has to resign because she saw fit to FAIL some little darlings who cheated and plagerized on a test. What the "H" is going on anymore.............. Mark

What's wrong with failing a little kid for cheating and plagerism? If they know the rules and they break them then they deserve the consequences....don't parents use this logic to punish their kids....oh WHOOPS! I guess parents as a whole are sissys now and don't punish their kids enough.
Do you know what happens in college if you are caught cheating and stealing material. You get expelled and blacklisted from most other major universities for a period of time because of your status as a cheat. Why then should little kids be taught something contrary to what they will experience later in life? They shouldn't.

When I went to Catholic school back in the 50's we were told to keep our hands on the top of our desks to keep us from playing with ourselves in class, so over reacting in school is not new. Always remember never wear patten leather shoes because they will reflect up and show the boys your underwear.
