I was curious if anyone else has had this problem. I was out to eat with my wife and a friend, pulled out a deck of cards and was doing some magic, the waitress told us we couldn't have cards out in the restaurant or on the table because they served alcohol. They said they could be fined or shut down if they were caught. any other magicians in Ohio or anywhere else have this problem or know of a law about this. We had to either put them away or leave.

There was another thread on this a while back. I believe that the author of that thread had the experience in Arkansas.
There's (apparently) no such law in California. Let that be a lesson to you, you scofflaw! |

I'm from New Jersey and I had the same thing happen to me. The excuse they gave me was that since they served alcohol it could be considered gambling. Don't know if it was a BS excuse but they told us to put the cards away just the same.

We can send troops to Iraq but we can't have a deck of cards in a restaurant. OK, I'm overreacting but that's pretty crazy. I've never heard of anything like it. So there's alcohol - and it might be considered gambling? So if there are women around, might the place be considered a brothel??

I heard from the owner of a sports bar in our area that said the same thing. It all started when they made the video poker machines illegal. Now, almost anything with chance is considered gambling.
There was a big raid on a personal residence in the area last year where there were some guys playing a friendly game of poker. They all went to jail and it is now being dealt with in the courts. Although the police thought is was ridiculous, they had to do it because of the way the laws are written. Can't wait to see what happens in the end. So far, several have plead guilty and paid a fine just to be done with it. Several more are fighting it trying to avoid setting court precedent. It's really sad when you think about it. Mark. |

Haven't had that experience in Florida, and the cards come out almost every time I'm in a restaurant. I think if it happened I'd just ask if they knew of any restaurants nearby that didn't serve alcohol, and I'd leave.
It's their right to ask you to stop doing anything they don't want you doing, and it's your right to go to another restaurant. -Rd |

The absurdity of it comes from the fact that the automatic assumption is that the cards will be used for gambling purposes. In my opinion, that makes it a bad law.
Ironically, there are some restaurants here in Ohio that have a resident magician AND serve alcohol, both at the same time. That makes this law doubly rediculous! I will never understand the reasoning behind how many of these laws are brought into being.

Several years ago, before I was performin professionally, it happened to me. The bartender tried to intimidate me, and it worked. I put them away. About 3 years ago, another bar it happened again. The guy told me it was a LAW in Pennsylvania. I told him no it's not, I perform in 2 different bars. I ended up leaving.

I would like to say something about this issue and how funny and silly I find it, but then I fear that Big Brother is watching me and that I will get arrested next time when I try to visit your beautiful country.
Some of the guys over there overreact somehow. Could cards also be used for terror attacks somehow? So never show a killer effect or even name it that way...

Yes Card Shark your ISP number could be traced and held on record.
I was told to put cards away when I was just with some friends.I replied ''If your establishment was'nt so dull and boring I would'nt need them'' I got barred.

Well reason is Gambling. Most of people assosiate cards with gambling, and if they don't have license they can get penalty, them not you. So that's why good places most of the time won't allow cards in.

I'm guessing some of the states that ban cards in restaurants allow concealed weapons as long as they are properly licenced. Any chance someone could issue a licence to magicians so that they can carry their 52 weapons of misdirection?
I love this country and I'll be very sorry to leave it in a few months when my visit ends. But man y'all have got some screwed up priorities. -Rd |

I guess I'm just a my way or the highway kinda guy when it comes to me paying for services. I would have said I'm not gambling and made some excuse up about not the right"kind" of cards and if they not like it id woudl leave to elsewhere

I did have the same thing happen in Michigan a number of years ago. So I did some research. Basically, there is no law against having cards or doing card tricks in a bar or anywhere else. What is illegal is gambling, and some bar owners and no doubt some state bureaucrats may be paranoid enough to worry about cards.
