Come back to planet earth!. When you hire a photographer you get the rights for reprints..... You obtain the digital or the negative and you have the photo mass produced for pennies.....

Actually, the photos have I had taken have unlimited media use (e.g. website, flyers, postcards, etc), so I can print as many as I'd like for promotional purposes for pennies on the dollar or use the photos on as many different promo items as I'd like, but right to SELL the photo is a different story.
Reputable places like "ABC Pictures" will NOT print photos from a professional photographer without written approval {verbal permission won't cut it}. Of course I could simply print the photo myself once so that the photographer's identifying marks wouldn't be on the back of the photo and then send it off for mass printing, but that wouldn't be ethical (or legal) in my mind. Anyways, I've figured out what I'm going to do and I thank everyone for the responses. Cheers, MJ |

I'm a little confused as to why postcard reproductions are allowed, but not 8x10 reproductions (lithos, etc). Care to clarify?
When I had some photos done a few years ago, the photographer did give me a reproduction release form. I was able to use my photos in a variety of ways. - Donald

Does that also mean you can't use the photos in products you sell (example - activity books, etc.)? - Donald

No, I actually used some for a DVD that I have for sale; the reprint stipulation was strictly for actual photos.
However, right now I'm in the process of negotiating a much lower price for the resale of the 8X10's. Originally I wasn't concerned with paying five bucks if I could pull in six or seven, but it looks like the going price is between one and five for BOR sales. MJ |

ABC will print your photos.... they print thousand of headshots a day....
Usually when you hire a photographer they understand the photos are for PR and they never hold the rights to them.... UNLESS you are a super star..... MJ, if you can't use them for resell have new ones made..... cheaper then paying $5.00 each... G's I think my last photo suite only cost about $700... so it is far cheaper then paying $5. to the copy right holder...

The fat of the matter is that EACH photographer is as individual as you n' I... as is each contract and terms of use and agreements.
How ever true it is, it is up to US to shop for the photographer AS WELL AS THE TERMS when having professional photography done. That said, though I know most of the folks that I know and/or have seen, that offer and sell photographs do, in fact get at-least $5.00 for their (and as some have suggested, give them along with others higher priced purchases) photographs. Keep in mind, that photographs alone are NOT the best selling offering we can make in our merchandising efforts for many of the reasons sited here and MORE. Certainly to offer photographs for sale is ONE of many solutions, it is always better to offer something of a “Higher Perceived Value OF THE BUYERS in our audiences”! Like I said… photographs are ONE of too many solutions to offer and list here. A quick SEARCH will reveal several discussions of other merchandising solutions. Thinking of YOU and your Success! I have to agree with the Dean here - photos are but one small item to consider for BOR sales. And I also agree that there are many items to offer that have a greater "value" to your audience than just a photo of the performer.

Why wouldn't I charge $5 for a poster?
I don't take my cues from clowns at birthday parties....I take my tips from merchandising at concerts. Like I said before, it's about creating the "IT Factor" (thanks Brad Ross) with my audience. And, the main reason I don't want to sell items for $1 is that it would hurt my $20 dvd sales. So if they say in their mind (Wow, $5 for a poster....I might as well spend $20 for a double dvd set AND the poster) I'm still learning about this stuff all the time, and I find it SO interesting to see what makes a product sell. A lot of it has to do with perception. In one venue, I was the opening act for the Disney Group "Jump5". 10,000 people in the audience. I did okay in sales, but it was hard to compete with Disney. 18 months later, I'm back in that same venue, only I was the main event that night. Only about 1,000 in the audience. I sold 3 times as much as the first time! To me, both shows seemed equally as good. Why did I sell so much more the 2nd time? Because my celebrity status was much higher that night. As least that's what I think. Next month, I'll be taking my kids to the circus. I'm fully prepared to fork over $12 to Barnum and Bailey for the cotton candy. Now when you can explain that to me, I'll feel much better.
