Is the recommended gimmick noted in the DVD a food item? And are the other solutions for the safe gimmick included in the DVD?

No and no. The one that is being reffered to is not a food item it was never intended as one however it is used in many items possibly in your home now. It has not been approved by the FDA and yes if you contact Jay directly he will provide to you another possible solution that is food.

You don't want to be caught up in a product liability trial. Those really get nasty. Any dealer who carries this item runs a very high risk, until either YOU or THEY get FDA approval on it. It is much simpler to put a label on the package that says, "Not intended for human consumption." If you do that, then the onus falls upon the performer and not upon you. Your "magic dictionary" is not what the law uses to judge toxicity. There are federal guidelines for non-toxicity. Acrylic paints are non-toxic, but they are not approved for use as face paint (although some really stupid face-painters use them to avoid paying for FDA approved face paint) because even though they are non-toxic, they contain dyes that have been shown to cause certain problems if they are applied to the skin and allowed to dry there. I'm telling you this for your own protection. If you feel like criticising me because I'm warning you about a potential problem and giving you a very simple way to cover your behind on this, then I would strongly suggest that everyone reading this post take heed and realize precisely what kind of a person they would be dealing with.

Let me add just one more log to the fire here. Your real problems would not come from the FDA at first. They would come from dealers who were not able to carry your product or who decided they wanted to put out a competing product and get yours off the market.
You may or may not have seen the famous "Billy Bob" teeth. These are prosthetic teeth that fit over your regular teeth to make you appear to have severe dental problems. They have been a hot item for gags and makeup since 1996. A friend of mine has been in the make up business for many years, and decided to put out a competitive line of these things. So, in order to make sure that he wouldn't have any problems with liability, he used dental grade acrylic to make the teeth. And that's where his problems started. When the people that made the original teeth found out about it, they reported him to the FDA. They couldn't get him on patent violations, because a similar product had been on the market since 1930 or so. So, what did the FDA nail him for? As strange as it may seem, the fact that he used dental grade acrylic for his teeth made his teeth "medical appliances." So, they tried to get him for making "medical appliances" without a license. They didn't realize who they were dealing with, though. This fellow is the kind of guy that when he has a problem like that, he simply puts his attorney in charge of it and they go after it in court. It took him about a year or so, because the case had to go to court and had to be settled, but the outcome was this. He lost a year's business, he had to pay legal fees. But he can still make the teeth, because there is no basic difference between the dental grade acrylic and the regular acrylic, except that the dental grade acrylic is certified to be safe to use in the mouth. In other words, it's okay to make dental prostheses for makeup purposes out of dental acrylic.

Bill,
I appreciate your insight about my product, but again, I would not release something unless I was 100% of what I'm selling. For your information and since you know so much about my product (apparently more than what I know), there is an alternative for one of the gimmicks that needs no approval from anyone, since it's 100% FOOD. Let's not even discuss the FDA regulations or the way they approve the products, otherwise many companies would have to go out of business I'm not getting the point of your posts: so you are saying that we should all stop drinking bottled water or milk or chicken? you know why? Because everything you eat and drink is full or preservatives and other harmfull chemicals. Unless you can proof my product is harmfull you have no right of making such statements or peoples minds. You don't need to teach us how to release products, or run our business Bill. Safety and satisfaction of our customers has always been our number 1 PRIORITY on everything we release, and for your information, we even had the contents of the product submitted to lab tests BEFORE the product was released to check for any bacteries, virus, or harmfull chemicals. So really, there's no purpose for further discussion with you since you are not aware of our internal procedures. Best Regards

There are loads of things that are consumed that don't have FDA approval. The material used in this routine has been around for years and sold for human consumption. I won't go further because I told the kid I wouldn't tip where to get the stuff but while I wouldn't give it to people to taste unless they insisted it has been safe for a long time.

I PMed Jay and hope to hear what he has to say regarding the taste issues. I tried this today and while it may have looked like beer I would never have given it out to anyone to taste. It simply tastes nothing like beer (at least right now). I will try it again if Jay has more instructions BUT all of that should have been more detailed in the dvd as well if there are more instructions to make it smell and taste like beer.
