Hi guys,
Ive got my first stage gig coming up and I already have a binding verbal contract which I have confirmed is good enough with my lawyer, however I know in the future I will want to have a contract written on paper, so I was wondering if someone could post a copy of theirs so I can take a look at it and see some things I should have or if I could just use it and adapt it myself. Thanks again for your help. |

Timothy Drake posted one in the grand illusion forum a while back. It was very comprehensive and valuable. Look for it. If you cant find it, PM him, hes a very helping fellow and I'm sure will send you a copy.

With credit to Mr. Drake: PERFORMANCE AGREEMENT Between PERFORMERS NAME , hereinafter referred to as the PERFORMER, and CLIENTS NAME hereinafter referred to as the SPONSOR, and dated this XXth day of MONTH, 2007. The PERFORMER, in consideration of PRICE dollars ($X.00) to be paid by the SPONSOR in the manner hereinafter described, agrees to provide the following magic performance. DESCRIPTION OF SERVICES: XXXXXXXXXXXXXXXXXX LOCATION OF SHOW: XXXXXXXXXXXXXX PERFORMANCE DATE: XXXXXXXXXXXXX PERFORMANCE LENGTH: XX minutes SHOW TIME: XXXXXXX EVENT/GROUP: XXXXXXXXXXXXXX It is expressly understood that the PERFORMER is an independent contractor, that he is not an employee of the SPONSOR, and that the PERFORMER is responsible for the payment of all applicable taxes on the consideration received for his services. The PERFORMER shall have the exclusive control over the means, method and details of fulfilling his obligation under this agreement except for the performance time and the length of the act. It is understood that the performance is an audience participation program, and that unless specific arrangements are made to the contrary, the actual length of the performance may vary from show to show by a period no to exceed ten (10) minutes. The SPONSOR agrees to pay the PERFORMER a deposit of fifty percent (50%) of total performance fee to secure the above performance date. Remaining balance due at the conclusion of the performance on the above stated date. If the magic performance is cancelled or postponed for any reason by, or on behalf of, SPONSOR, the SPONSOR will still be liable for payment in full (100%) of the consideration provided for herein. In such event, SPONSOR will make this payment to PERFORMER within ten (10) days following the date of the scheduled performance. This agreement shall be interpreted and enforceable under the laws of the state of XXXXXXX. Wow nowhere near enough.
Get ahold of an attorney, and have him write one for you. It is worth the money. What if someone is hurt during your show? Walking to the stage and trips on the stairs? Your fault, venues fault? Oh and find a new laywer while your at it. A "verbal contract" is not worth the paper it is written on. (yes that was a joke but still true). You are going to be using a LOT of people, things happen. You need to clarify if your insurance (god tell me you have some) or the venues insurance will be used to cover it. Find a lawyer who wants to spend the time to do it.

A few weeks ago there was a Hyp Show performing here in NYC.......I won't tip the guys name as he has his Headachs as we will read shortly.......
Towards the end of the act the Hypnotist Attempts the chair suspension (Not the Illusion )with a lady from the audiance, who was under the Hypnotist influence then proceded to stack a nunber of Heavy ! Encyopecic size Books on her Midsection..Ok , No problem.... Books are removed then he has a Man FAR OVER her tiny weight Stand on her mid section......Well now it gets messy & Simply to unbelievable to be true , but it is...... The guy instead of stepping gently on the lady ,Almost " jumps" Onto the poor ladys belly . Next ALL HELL BREAKS LOOSE !!!! She wakes up as the 2 Chairs Collapse Under all of the Weight, her husband who was sitting in the Audiance FLIPPED OUt !! & wanted to kill Both the Hypnotist & the fellow sitting on top of his wife, She was taken out of the theatre in an Ambulance The bottom line here , have Lots of Insurance , know your craft & Don't p__S OFF husbands if your not sure what to do wl1 |

This is why the hypnotist should have explained to the man exactly how he was supposed to get unto the lady. Insurance is always good. If you know what you are doing and do it right, then you should never have to use the insurance.
