I want to use some music/songs in my act from famous artist. Of course I want to get permission from the right person so there will be no law suit. Do I get permission from the artist themselves, the production company, from the agent/promoter of the artist, etc?
And does it usually end with just a signed piece of paper giving the approval, sums of money per usage, one large amount of money, etc? |

To use music by any commercially-released artist (especially someone famous), you'll need to contact ASCAP or BMI to find out about proper licensing fees. You will also need to obtain a license from the record company - while the artist owns the song, the record company owns the actual recording of the song.
And if you want to record the music onto a promotional DVD, then you will also need a "sync license". In my experience, this license is the most difficult to obtain. There is also a "master use" license that will allow you to sync the music to video, but it is the most expensive of them all. All of these licenses will generally expire after so much time (ie: 1 year, 5 years). Then you need to renew them. So, if you make a DVD of your act ... you would need to either stop selling the DVD when the license expires, or renew the license. There are a few alternatives, like http://magnatune.com/ which offers low cost licenses. A search for "production music" or "royalty free music" will bring up a lot. Some of these tracks will still need an ASCAP/BMI license. Overall, after attempting to obtain the licenses I would need for my DVD I ultimately decided to go with Creative Commons music. You can search through http://soundclick.com for smaller bands that are unknown and want their work heard. Seek their permission directly, and since they are unsigned there will be no record company to stand in your way. This option will take you the most time, as a lot of this music is not very good. -JoeJoe
