Hi,
Having seen an advert for a couple of books, contacted the chap and then found that they'd already been sold. He's told me that he has the ebook backups on CD if I'm interested. The books are Absolute Magic and Sense of Touch. Now, somehow I smell something fishier than a trawlerman's net at full capacity. Did these ever come out as an ebook? All me senses say stear clear of this and it sounds like someone's on the make. Any ideas? |

Stay away!!!!
Absolute Magic will never be sold as an ebook. You have contacted a scam artist. Be afraid, be very afraid!!!!! Peace & Love Matt |

Furthermore - if it was Ebay - report them! An email to the creators might not go amiss too.

Thanks gents. Thought this sounded dodgy.
I'm keeping clear of this chappie. Wasn't ebay but was another magic website so I'll email the owners. "Mucky Bucket" as they say in pigeon French. |

This isn't the first time I read this... It's a double cutting sword, really. On the one hand : those books are out of print, which only encourages people to do things like this, while on the other hand a reprint could be a solution. BUT many people wouldn't buy the reprint because they already have an illegal version.
The wonders of modern technology. I long for the days that you could just buy a book when you wanted, without worrying about limited editions, and savour it without knowing that hundreds of others have the same info without paying a dime, just by distributing pdf versions... Bloody awful, this internet can be (said in a Yoda voice) |

Even if they were available as ebooks... if he has already sold his ebook, he wouldn't have the rights to keep his backup, nor would he have the right to sell those back ups to you.

It would be service to others to name this individual publicly on this forum.

Why ?
I see where you come from, but still, I'm in favour of "dealing with things in private". |

He can still continue to sell unlawful copies. If you "out" him, perhaps the light that you shine on his business practices will allow those he's stealing from to take action to stop him. It would also warn authors and creators not to sell their goods to that person.

I see your point. No warnings, but immediate action.
The sad fact is, that for every pirate you shoot, ten new ones will arise. So, perhaps legal action isn't the best way to deal with this. And the current tendency of creators to release pdf's instead of books (and expensive pdf's sometimes), only makes piracy easier. It's a bit a structural problem that won't go away so easily. And it's not only in mentalism of course : all arts suffer from this. Take films, for instance : "Wolverine" was online before it even hit the theaters. Such problems should be dealt with at the source, but of course, that is easier said than done. |

I've bought a couple of mentalism ebooks and, having decided that they're not my style, wonder if it's OK to sell these. These have unique passwords to myself which if released onto pirate websites would be immediately traceable by the author back to myself. However, if I have decided that I wish to sell these, then if I have removed all backups and send them on to the new owner, am I responsible for what they decide to do with them? It's a bit like a seller of cutlery - if the purchaser kills someone with one a knife you made, are you responsible (obviously no). Now, the author of the pdf has also written that the book is not for resale, how can they not allow me to sell something that I have decided is not fit for my act? We all buy things that upon opening and reading through, decide that it doesn't fit and so sell it. I have seen lots of "real world" books on here for sale that have the "not for resale" in the flyer. I'm wondering what "not for resale" really means now. So... can I sell the book and have a clean conscience that I haven't been bound by an unenforceable statement? I suppose the best option is to alert the author to the details of the new owner after selling it. What would you do??? |

IMO, it's perfectly ethical, and (as far as I know) legal to sell your ebook. It's just a piece of software.
Just as it is perfectly legal to sell your copy of MS Windows, provided you provide the original disc, key and delete your copy. HOWEVER, with that said, even books, both physical and electronic that I have purchased, I have yet to sell any, even if I didn't feel it was my "style" or taste. WHY? Because I never know when or if that info may be of use to me somewhere down the road. In the words or the great Kool Moe Dee, "Knowledge is King"....lmao |

I've had my ebooks pirated, and even printed off, bound and sold on ebay!
and I'm about as low on the rung of the ladder as you can get name wise... I wouldnt sell off ebooks that I'd bought - I've gain some kind of knowledge from it, even if its "don't buy from them again"...and you can often learn from bad things as much as good things...cos you can take an idea and say right - this is what I would do... I couldn't bring myself to sell any of my books or even dvds to be honest...
I've asked to be banned

Same. I also don't sell real books that I've bought. I frown on people selling mentalism books second hand. What's more, I don't draw any distinction between selling a 2nd hand physical book vs ebook.

I've always thought that it was not only unethical to sell ebooks, but illegal. It's too easy to sell your copy of an ebook while still keeping a copy. When you sell an ebook, are you not just selling a copy of it, while maintaining a copy on your computer? I don't know much about ebooks because I stay clear of them for good reasons.

It's not illegal. Even if an ebook is bought on the basis that it cannot be resold, it's likely that that condition could not be enforced in many jurisdictions.
