Tony, you know Keith has been doing hypnosis for ten years now, right? His previous show had a good 15 minute bit of essentially pseudo hypnosis though with most of the trappings of a proper show such as audience wide suggestion tests and inductions.

I know he has been claiming to use hypnosis for ten years, but the pseudo hypnosis he had included up to now was so weak, and so prop-based, that you would hesitate to call it anything but trickery. However what he is touring with now will someday (soon) be a very strong hypnosis show. He has all the charisma and stage presence needed.
And while he thrives he is making hypnosis cool again, and we will all ride the gravy train on his coat-tails. I have begun already; I am promoting my own show for the first time on Saturday evening. Its a big step going from being hired to taking all the risks, but I am looking forward to it. A big thanks to Mindpunisher for all his marketing advice.

As a side note, if someone does pseudo hypnosis, but claims to be doing hypnosis, could a venue or member of the audience sue him for misrepresentation? I realize that a person doing this could develop a strong defense, but the court costs alone, even if you win, make this potential a problem.

Yea it will be the biggest victory since my law suit against "The Never Ending Story".
I am going to sue every actor who pretends to get shot, every comic who claims "this is a true story" and every singer who has not experienced everything they sing about. Johnny Cash comes to mind for Folsom Prison Blues. For that matter everyone who claims to read minds or do magic. Oh and Emminem is done for when I get finished.

You cannot sue someone for misrepresentation. For a civil suit be be braought there must be DAMAGES. If you not harmed, no matter what has happened, there is no claim. Danny has hit the nail on the head with his analogy

It's sounds as if, fortunately, you've never been a victim....er...part of the U.S. legal system. In the U.S. you can be sued for anything. The costs of defending yourself, even if you win the case, can be extensive.

Ireland is a far more litegenous society than America, and we sue, and are sued, at the drop of a hat. I have been the victim of the judicial system - but I have won a lot more often. However even here I would not imagine anyone would sue over a pseudo hypnotist pretending to be a real hypnotist. They would have to sue just about every hypnotist over here. As has been pointed out, without damages there is little chance of being sued.
There is a lot of exaggeration about the dangers of being sued. I remember one of the papers carried an article about a volunteer who had to be hospitalised after my show, because he suffered a massive epeliptic fit. The volunteer did not sue me, despite the paper article, because the incident did not happen as reported. He got the fit hours after my show because he went out drinking, and got hammered. The alcohol reacted with his medication, and the fit had nothing to do with hypnosis. I suspect most horror stories, when you get to the bottom of them, have nothing to do with hypnosis.

Wanna know about frivilous law suits against cops? Wow just keep not looking at things.
The urban myth of suing for anything is what you are propegating. Damages in the case you mention would be limited to at most the price of the ticket. IF you can get it before anyone. Cost to defend? 0! Get a grip please.

I didn't ask about "frivilous law suits against cops." I asked about law suits against you, personally, where you were not defended by the police union or another similar organization.
I've got a great grip. But then, it would seem that I was sued and you weren't. |

The state I was a cop in, thanks to an ex gov. did not allow anyone but the cop to pay for defence of his law suit 1000 years ago when I was a cop. But again, keep thinking what you like.
I don't care what you have been sued for, there must be grounds for a law suit. There must be damages for any lawyer to take the case in the first place. Like I said damages, limited to ticket price.

You can be completely innocent and be screwed by the legal system. I failed to display an insurance disk last year (the van was fully insured) and it cost me over E16,000 in legal costs. If I had known I would have taken the initial fine and disqualification and driven on a forged licence for the year. I know now, and I will never trust a court again.
The problem is that the law is cold and impassionate, but the lawyers, court officials and judges are venal, corupt, greedy and petty. Don't get me wrong; I have met several honset lawyers, but few enough judges I would trust. And I will never trust a court again - but that won't keep me from sueing people. Dmkraig, you have my sympathy. It is a horrible, emasculating experience to be screwed over by the legal system. But I still think no one will sue me for misrepresentation despite the fact that I have never knowingly hypnotised anyone.
