Hey Everyone,
So as you know I have stated here in this forum there is a performer with the name 'Agricadabra.' and my name is 'Agri-Kidabra.' He called me and e-mailed me last night intimidatingly demanding a name change on my part. "I did talk to a lawyer this morning and the fact that you changed letters does not change the fact that they sound the same. To him it would still fall under intellectual property." So my issue is - do I give in and change after all my flyers, posters, and envelopes have been printed as well as the design work on the banners? Or do I keep moving forward? Do I go and register it as my business name? Because right now it would be around the $600.00 mark in promotional material worth garbage. He sent me a list of different names to suggest - none of which I'm a huge fan of but hey if you like something, or have a suggestion for something let me know! Well...it seems he does work in your part of the world and thus you were stepping on his gig. You have a choice, you can get legal or go ethical. I don't really see anything wrong with Magic on the Farm only I think it is being done by a guy who was in Magic Magazine years ago. Good luck.

The guy your thinking of was farm yard frolics. He now only produces shows for theme parks and does not perform himself any longer.
He is in the USA, I am in Ontario Canada - so I didn't see me stepping on his toes at all. Not to mention he does week long and large fairs - in ontario we have many small two day fairs and only 3 week long fairs - which have the same entertainment for 10+ years before the change. Daniel |

Question: Why would you want to confuse your potential clients about whose show they want? If the name of your show is that similar to another show already on the market, how will you differentiate yourself in the mind of the client? OK - we aren't talking about ethics or legalism now, we're talking about marketability. The first thing the fair directors will notice is the name. If it sounds, looks or seems too much like another name they have seen, you will have a harder time standing out in their mind and positioning yourself to be the product of choice when they make a purchasing decision. I feel your pain about the money you've already spent on promo materials, but spending more money on postage/trade show/branding efforts will be even more expensive if the name turns out to be a non-winner. wes holly |

Wes I greatly appreciate your opinion. I'm weighing all my options at the moment and have lots of gigs right now thanks to Canada day to worry about it all. I'll let everyone know my decision or ask for more advice.

I did offer to pay for part of his expenses and I don't mind him doing an AG show, I think that part is great. After we talked nicely I talked with a lawyer I workout with and asked him his opinion and I told daniel. I have been talking with fairs in canada and have had a canadian agent for over a year. which daniel was told back in Feb before picking a name

Legally as I understand it you cannot copyright a name. I could call myself Lance Burton, and put up the posters. But I will be caught out when I am compared to the real thing.
Similarly I could change my name to Dan Brown and rename one of my books The De Vinci Code. It would sell, but damage my reputation. That's what it comes down to. If Agricadabra operates in your area - and he seems to - then Agri Kid Abra is a bad choice for many practical reasons. Even if he could not legally enforce his right to the name (I don't believe he could) you are hurting your business by keeping the name. So make the change now and be done with it. A good performer in my city moved to another city, where she discovered a clown operating under her stage name. Instead of fighting it (the other was better established in the new city) she just changed her name, bought new cards, and is now operating successfully under the new name. The bottom line is that this is not a question of right or wrong. It is a question of expedency. Change your name.

I don't think he'd sure how he's going to spell it yet, I've seen 2 different spellings, the problem is they sound too much alike agricadabra agrikidabra.

So brad arrogantly emailed me an rather rudely told me that he bought the domain name which doesn't bother me as I will only be putting it as a section on my personal site.
First he offered me money and now refuses to even talk with me sensibly about it. I have made my decision and am movingwih my show. Daniel |

I know if a rival, especially one I was in discussions with, bought a domain name to prevent me doing a piece of marketing, that would be the decider for me. It would be war.
I would go ahead with Agri Kid Abra, and hang the consequences. Use your marketing materials, and best of luck with it. Tony.
