I've posted this question in another thread, but thought it would get a wider response in its own thread.
Here is the question and some background: I ordered a key effect from an on-line dealer. The effect was listed on the website as "Key R Rect." The product I received was called "Three Key Monte" and requires the performer to touch the lock. I complained to the dealer that this was not the product "Key R Rect" even though you could perform the "same" effect. The dealer told me that there was nothing he could do for me. The product was mine. So the question is: if you see an effect on a website called "Key R Rect" are you justified in assuming that it is the product associated with that effect (requiring no performer contact) or just that you will get something that can perform the effect, albeit with different limitations? The communicated limitations after the sale should be no different than the limitations that were communicated before the sale. Simple as that.

Cannon Escapes makes a Key R Rect Knock-off.
KEY CHOICE A McColl Creation © 2002 The MENTALIST (that's you!) shows a locked, brass PIN TUMBLER style padlock and six keys. A volunteer tries to open the lock using each key. None of the keys will open the lock. You then introduce the last (7th) key. This key does open the lock. You then show the padlock to all--illustrating that the shackle is clearly and truly open. You lock the shackle. All seven keys are then mixed. Through "ESP" (?) you select a key. The volunteer tries it, and of course you have succeeded! The lock opens! AND HERE IS THE GREAT PART THAT WAS NOT POSSIBLE BEFORE WITH OTHER "ESP" PADLOCKS: After the demonstration -- and without re-touching the lock or keys -- you just "happen" to conveniently leave the padlock and all seven keys on the table. YOU KNOW that someone is going to be curious and try the keys and lock again! THAT'S OKAY! Because once again, ONLY ONE KEY WILL OPEN THE LOCK! This really Solidifies that all is fair(?)! You must truly be a Mentalist! Remember, this is not just a warded style lock, but a more sophisticated PIN TUMBLER style. A mechanical marvel! |

Key R Rect is not as general as "a Coke" to me... In that case you could expect any taste/brand of Coke
Key R Rect is like "Coca Cola", you would expect a specific item. I don't think it makes any difference, but I wonder if there was a picture in the product description ? If there was a picture, was it the one of the product delivered ? IMHO the dealer should know that this was misleading and should refund without any other questions asked. Rgds Serge |

Seems to me that if "Key-R-Rect" is what is advertised and what you paid for, but what you got is NOT "Key-R-Rect" you are the victim of an illegal "bait and switch" scam. If the transaction (i.e., payment and delivery) was conducted by mail then "mail fraud" -- or if over the Internet, "wire fraud" -- may be involved; however, I am not an attorney and if either purchaser or seller is outside the USA US law may not apply. In any event, it seems to me that you are entitled to redress. Having said that, "entitlement" and "satisfaction" are tow different things and it may well be that getting either a refund or the "Key-R-Rect" you purchased may be far more difficult and costly than chalking the whole thing up to "lessons learned."
Whatever the outcome, you should certainly let the world know (via the Café and every other Internet magic forum you can access) the identity of the dealer who ripped you off so that others can avoid him.

I'm curious what the description of the effect was. Is a matter of misusing the name Key R Rect, or did you get a totally different product then what was described?

I'd have to see the website to tell you if it was misleading or not. but if it SAID key r rect, and had no mention that it was not the original, I would think tht's very misleading and should be corrected. I understand the whole "magic is the secret" but would you take an exchange for the correct product.
If you send it back to them via certified mail (so it's signed for) and refuse the credit card payment, you'll win. Where did you buy it? |

Follow-up
Thanks to all of you who have responded. You will be interested in what I hope are the final developments. The seller contacted me today. It appears that he gave further thought to our issue. He offered to give me a store credit if I returned the lock. I felt this was a good faith attempt to resolve the matter, and I agreed. I will return the lock and expect to receive the credit. The seller also changed the description of the effect on his web site. He still uses the name "Key R Rect" as the title of the effect, but has changed the content of the description to state that this is not the original Merriss/Wolf effect. So there you have it. I think that the seller ultimately acted in good faith to get this matter resolved. Thanks to all of you for your comments. Gianni |
