The reason it is three strikes is because in baseball there are three strikes and, by golly, it sounds good.
I have to say while my brothers friend is a nice kid to me (I've known the lil punk since he was three) he really, clearly, needs to be off the streets. He can't be out of prison for a month without doing something stupid and he's a little dude and looks girly, they must love him. He's been in for almost 22 of this last 22 years of life, and all for stupid things like the bat smacking. |

One thing about having an "X Strikes" law is that when someone gets to X-1 and still lacks the desire or self-control not to re-offend, it really tells you a lot.

Not excusing them. Just explaining why expecting them to rationally go, "Oh right, this isn't in my best long term interests" so often fails.
John PS, I'm coming up empty in my search for a statistical basis for 3 rather than some other number of strikes.
