I doubt it. He has also taken to slamming people in retaliation using the rip off report and customers email.

Do not link onto the Ripoff Report. It only keeps it up in the search engines. They post anything flaming whether it is verified or legitimate or not. they then offer to help improve your reputation for $$$$. They have off shore servers in China, have judgments against them and have had the Rico Act (extortion violations) enacted against them. It is a bad, bad deal. Do a google for the Ripoff Report problems before you click to see there website.

It is another case where cyberbullies can try to ruin a person's reputation without fear of reprisals.

In addition, the above linked site is from Turkey.

I don't understand why every post against Snap is deleted here. The Genii Forum is full of posts where people reports being scammed from them. I also know a guy where has been ripped of. He paid for an illusion and never got it.

I thought part of the purpose of a forum like this is so that we can HELP one another...which in my mind includes warning against scams. It would be one thing if it was just one ****ed off customer ranting and raving and stirring the pot...but this seems to be a universal problem with this guy.

I thought the same. In particular because the slogan here is "Magicians helping Magicians".

Patience my friends.
After collecting a lot of information I believe I found the big mistake he made
and also a way to prove that he never intended to ship to the people I listed
in the Ripoff report.
But please understand that I do not want to go into details.
He is reading a lot of posts and I want to avoid that his past mistakes are covered
before I can use them against him.
I will keep the community informed when I press charges later this year
and what will happen then.

So question?
is the issue that snap takes orders and does not deliver them OR
that he is building poorly made knock offs
or
both.

I mean the guy has been around for a while and even now new website and bigger shop obviously some one is buying his props.

just looking for more clarification as to the problem here.

thanks

Hi Sam,

legally it would be quite difficult to claim bad quality.
The average judge would not be a specialist for magic illusions and how can he/she then make a decision whether a prop is perceptive or not?
Additionally, if someone goes for a low price, it will be difficult to argue that he did expect a similar quality like he would have expected from Owen or Wellington or others.
So from my point of view the area of quality and knock offs can hardly be solved on a legal basis and would only confuse a judge if it is mixed up with other issues.

Even if someone takes money and does not deliver in a single case, it might be difficult to win in a court against such a person, because it can not be totally excluded that a series of unfortunate delays or simply bad luck leads to such a situation. Especially if the receiver of the money always claims that he/she has every intention to deliver, just a little bit later, like "It will be shipped when it is finished".
So, the target for a successful claim is to prove that at the time someone offers a product and takes the money, he/she has no intention to deliver.
If that can be done for several cases over a longer period (like 2 years), than there is a good chance to win.

Therefore it is necessary to temporarily focus on this part only and not mix it up with arguments about quality, where a judge might not be able to follow.

During my vacation in the past two weeks I think I finally found the right way to prove that there was and is no intention to ever deliver to at least 7 customers between 2009 and 2011 and somewhen in June/July I will have the time to find a lawyer to press charges and present my collected documents.
There seem to be more people who might have reason to complain and join someone who starts legal activities, however it seems that several people want to protect their anonymity and do not want to admit openly that they also tried to buy from that company. Maybe they are scared that they would be blamed by others? I don´t know.
In any case, I can only include those who agree that their names, addresses and documents are given to a lawyer and who are willing to help and do something.
Just only complaining under a pseudo name will never help to put an end to this story.
So, if someone else wants to join, send me a PM and let us discuss what I need and what I could do.

Regards
Richard

P.S.: I hope I did not violate any written or unwritten rules of the Café by talking about a purely theoretical situation Smile

When an illusion is supposed to be delivered on a certain timeframe, and it is not, the client has the right to demand his money back. The court will MAYBE give Snap a leniency of 2-4 weeks past due...but after that, the client has the right to ask for his illusion or money.

Reading the above post, I'm assuming nobody gets a signed contract when ordering thousand dollar illusions. The contract will give specifics on deadlines and timeframes. There has always been a case against these guys, but apparently theres not an attorney in the USA that has a clue to what they are doing. Its an easy case...time and time again.

To say that all he has to state is "unseen delays and bad luck with intent to deliver" is 100% false. Those are his problems, and not for the client to have to deal with. You are expected to run a company KNOWING that there will be delays, and you should accept orders based on the chance of those delays. Therefore if you can build an illusion in 2 weeks, you state 4 knowing there may be delays. You don't state 2 weeks and if something comes up, then oops it will get done when its done.

I like the direction you are thinking and going...but just know he has to follow through with his agreement just as you did when he made you pay. Intent to deliver means nothing after a short amount of delayed time.
