And as any attorney knows, speculative evidence without foundation is not admissible, and claims not made by the (allegedly) aggrieved party may be waived.

Read exactly what I wrote: "If Walmart did, in fact, breach the good faith requirement, the "bullying" claim being discussed in this thread would be well founded." Note my intentional use of the words "if" and "would be." As every attorney knows, the exact words are critical to interpretation. (Just busting you.) But I think a 'good faith' argument might well carry the day IF, as you already noted, the was a somewhat better 'poster boy' for Walmart's abuses. |

I mean, we lawyers know it's all "arguable," but is that really side of this one you'd want, if you were playing for your life? He made a bargain with eyes wide open, then stuck to it. You're going to have to treat your own guy as a hostile witness.
