There are precedents in this area that go back to the War Between the States. When he decides to take arms against the United States, does a citizen forfeit his citizenship? Would a foreign enemy combatant, operating on US soil but in civilian clothes, not in the uniform of any country, have the right to a trial? In the Second World War, 8 German saboteurs were landed by submarines at Amangansett New York, and Ponte Vedra, Florida:

But if the living terrorist had sworn oaths of allegiance to a foreign terrorist organization, I think a reasonable case could be made that he had forfeited his American citizenship. As an irregular, enemy combatant I think the precedent would be to try him before a military tribunal. |

Did the FBI phone Boston suspect before fatal shootout?

I'm still struggling to understand why the photos of the suspects were released (and by whom) if the FBI had prior knowledge on the older brother (who was surely recognisable from the images). Why didn't they simply go and arrest them? Don't the different agencies talk to each other?

A couple of related thoughts.
I'm thinking that this bombing was a carefully planned military attack. The purpose was not solely to kill infidels or terrorize a city, but more specifically to gather intelligence on how, in 2013, civilian and military authorities in the US would respond to a terror attack. I was initially surprised that the two Chechens were not prepared to immediately leave the city and travel thousands of miles away, before anybody was really looking for them. Their escape was evidently not part of the plan. They were expendable assets, and part of the purpose of using them was to observe how the authorities looked for them and eventually engaged them. I would think that the planners of this attack were monitoring police and military frequencies, and might have also hacked into internet communications. They've probably downloaded a ton of information, which they will analyze carefully in order to plan for the next really big campaign. One thing, for example, that was interesting, was the immediate appearance on the street, right at the bombing site, of military-style security personnel in the desert tan boots, khaki slacks, and black tennis shirts of a private security company called "the Craft." One of them appears in photographs to be using a geiger counter device. I'm sure that this is an expensive outfit to engage, and I'm wondering who hired them. Is it routine to hire such operatives for every special event in Boston, or elsewhere? Or was there specific intel that alerted someone to the desirability of putting such assets into place? |

I think a little waterboarding is called for. Brings out the best in these guys. After that put him in a room with the people who lost loved ones and the parents who lost their 8 year old son. Just for about a half hour or so. I am sure these people would love to hear about his American Citizenship from him personally. That way they could understand him better and understand why he killed their loved ones with a bomb.

It is my view, that given this guy's ties to a foreign terrorist organization that has declared war on the US (and I say this because Al-queda incorporates various different Islamic insurgencies around the globe and I believe this Chechen terrorist organization has Al-queda ties) he should be declared as an "enemy combatant" interrogated for intelligence value and then put on trial for treason or an enemy combatant or both. The war didn't end with the killing of OBL.

When you look at recent terrorism cases, military tribunals have been far less successful and efficient than our regular court system.
Anyway, all those wanting to suspend this person's constitutional rights for a little safety- you aren't the same people screaming about violations of the second amendment when there's talk of universal background checks for gun sales, are you...? Because, you know, he is a citizen, and you can't have things both ways.
