When it comes terrorists cases the police re questioning have used all sorts of cleaver trickery. One example which was used was to use a cop dressed up as a priest, who would go to to cell and get a confession from the prisoner. In court the cop would deny posing as a priest and so on. All is fair in love and war. When it comes terrorists the gloves come off. The rules eh

Lawyerly? Not at all. Just simple English construction:
"You have the right to remain silent. Do you understand that? You have a right to an attorney, do you understand that? Not at all the same as saying, "I'd advise you not to say anything." The former is a statement of fact, required by law to be given to all persons when they are charged with a crime. The latter is a suggestion and bears no resemblance to what the magistrate actually said. |

I think the take away from all this, is that there is no way anybody can know all the laws in the various different states and there are so many ways and strategies cops can use to get around things that it's best to treat the police with respect, treat others with respect, be responsible and follow the law. Ultimately, nobody is going to outsmart the law or the police. They'll get you if they decide they want to get you.
So following the law, being responsible and not making enemies with the police (or trying your best not to make enemies with anybody really) is probably the smartest thing anybody can do. It's pretty foolish for anybody to think they can outsmart the law or police or that they can get away with things just because they have a lot of money. Do people get away with things sometimes because they have a lot of money? I am sure it happens, but ultimately, I think in the long term and in the end, cosmic justice, the police or the law always have a way of coming back around to those who have it coming to them even if they have enough money to hire top notch attorneys to defend them.

By the way just because one is advised they have the right to remain silent does not necessarily mean they invoke that right.
While as soon as they ask for a laylwyer you stop an interview if they do not ask for one you keep going. Some think they are smarter or you have less evidence than you do. General you look at a victim or two in the eyes and tell me if the word trickery still applies when you are simply using every legal means at your disposal to find the truth. Key word LEGAL. You were advocating for changing rules to declare a citizen an enemy combatant and want to use words like trickery to describe honest police work? Crime has been evolving for decades and cops have been on the front lines of this battlefield for the whole time. It is about time some change in thought took place. The perception of legal means being trickery is absurd. You are not so consistent when in one case it is ok to rwdefine status for convienence of investigation and in the other legal means is trickery.

Indeed. Contrary to popular belief defence lawyers will often advise their client to confess, rat and plead guilty. The defence lawyer on a guilty plea wants to be able to say of his client he confessed immediately, helped the police and showed remorse and so on. If I was this kids lawyer then I think I would want to use what he said before the warning if it helped him in his mitigation in that way. Only if he pleaded not guilty, which is unlikely in this case, would I want any confession he made before the warning was given not to be used. It seems cut and dry “at the moment” that he is and will plead guilty. Thus that is just a side issue. More important or interesting is to look into why they did it. It seems to me.

Very good points, Danny. At the time Miranda was handed down, some law enforcement "experts" predicted that no crime would ever be solved. But as you note, in many cases, it is possible for a person who is being interrogated to talk even though they have been advised they don't have to.
I remember a well-known case in Baltimore, of a very accomplished 18 or 19 year old serial robber and murderer, who was persuaded to bare his soul by an adept interrogator who told him that he was a nobody who hadn't even done anything notable. "I done some things . . ." the suspect began, and it was clear sailing from there. |
