Hello y'all,
I'd like to know how the propriety of a published trick works. There are 2 motivations behind this question : - I'd like to know how I can protect a trick I'd want to publish - I'd like to know how I can publish a variant on an existing trick. For instance, if I see a nice routine and find a way to make it better, can I quote the original version and explain mine, or should I ask for authorisation first, etc. Thanks SG |

The real answer is: It's complicated.
You say trick but you describe a routine. A trick, to some, would be the apparatus, the physical equipment used to accomplish the effect. The routine is the script and choreography, movements, of the performance of "the trick." To protect your interests in creating a new piece if equipment, you'd need a patent. To protect your script, you need a copyright. It is possible, and fairly common to get a patent on an improvement of an existing invention. But your patent would only cover your improvement. If you intend to sell the whole thing, you'll need the cooperation of the other patent holder(s). If you are talking about a script, and are planning on using part of someone else's published and protected script, again, you need the copyright holder(s) cooperation. In either case, it takes lawyers, contracts, and MONEY. You'll likely not get good advice on that here, or on any message forum. You'll need a lawyer who specializes in the appropriate field. I don't mean to discourage you. In fact, if you know you have something great, I think you should go for it. Just do your research and make sure you cover your donkey. Bazinga! |
