Be snarky all you want. The fact is you didn't have facts and it seems as if your assumptions were wrong. Sorry that brings out snarcasm in you.
But since you demand facts from others it only seems appropriate you are familiar with a couple as well.

For the lawyers and law enforcement posters here, I'm wondering if there are straightforward answers to these questions:
So a homeowner is in his or her enclosed backyard, enjoying some illegal concoction. Police drone overhead sees it. 1) Can the homeowner be arrested? 2) Can the police get a warrant to search based on this info? 3) Can the police enter without a warrant?

The drone was trespassing. The drone operator had a lot of open space to fly over to get to his target. He took a very unusual route to get to his destination, in fact an out of the way route. You will notice he was not charged for damaging the drone. Apparently the law didn't see that as a problem. He was charged for shooting a gun, not killing a drone. Apparently the SD card is missing so we won't know what was videotaped. This is a property rights issue and there are no real laws to govern. |

No one really knows. Navigable airspace starts at 500 ft. Above that FAA owns it. Drones have to fly below 500ft. How high your air rights go is not defined by law. The FAA is going to try to lay claim to all of it, but we'll see. If they do, then I expect drones will have to file flight plans. There was a case at the Supreme Court where a farmer was complaining about airplanes buzzing his house and scaring the cows. I think they determined they had to stay 83 feet above or something. So up to 500 ft is open territory. Planes have to stay above 1000 ft above highest building in congested areas, but over water only have to stay 500 ft from other objects. If under air traffic control, that can change. Drones are in a untested area being below 500 ft, but no real determination on how much above a building or property.

If I were to agree with you. Then we would both be wrong. As of Apr 5, 2015 10:26 pm I have 880 posts. Used to have over 1,000

FAA rules regarding plane distance from objects and in congested areas are designed to limit ground damage if an engine goes out. They're about manned and large aircraft. You can't buzz a house at 50 ft. Drones are a gray area. They have no right to airspace below 500 ft where they are forced to fly. It will be a property rights issue unless the FAA can claim all airspace. That will cause a lot of issues as well.

Before this thread disintegrates entirely, I am wondering if anyone had some solid info about my previous 3 questions? I think they are kind of interesting and increasingly relevant.
