Oh and "nobody has the authority"? I beg to differ as does our courts. No one has the legal right to harbor evidence in a criminal proceeding. If you have a fugitive in your home and the authorities know it, you either have to give him up or be charged. and if it's a lock to the front door that's stopping the police from entering, the lock company nor the home owner has a leg to stand on in not providing a way into the residence. they would be charged.

I'm not sure about prism, but Stuxnet source code is avaliable on github and the source code for XKeyScore is also available; includes comments by the coders that provide some insight into the mindset of the NSA.

This isn't even about a terrorist's phone - what they really want is access to your phone to keep their system going, so that when you wife divorces you they can access your phone to find out if you were cheating on her ... that way they'll know how much of who's money to give to whom. Kinda sucks when a court issues a supenioa for someone's phone and it can't be provided because it is encrypted.

Everyone freaks out when they find out the government is spying on them, so their next reaction is to demand the government be able to spy on them ... asinine!! Sometimes ya'all's logic just cracks me up.

Because this is not about a terrorist's phone - the FBI has most likely already tried ten incorrect passwords and that phone is dead on arrival anyway.

This is about the fact that the new iPhone can't be subpoenaed in court because the data is encrypted. I can liken it to the government demanding I unlock a phone as easily as I can see them demanding Tim Cook do so.

And our courts do not have the authority to compel people to do things they don't want to do; the fact that they have historically done so unconstitutionally does not change that fact. The courts did not write the constitution, "we the people" did and we are it's ultimate executors having authority over every branch of government.

The idea that the court has authority over "we the people" is laughable at best. Many journalists have gone to jail to protect our freedoms, Tim Cook may be next.

One though I do not see discussed above. When a Search Warrant is issued it is for specific evidence based on convincing a judge that there is a high likelihood
that the evidence exists and is at the specified location.

Here there is no strong evidence that any specific evidence exists -- or any at all. Or that even unencrypted it will be readable.

Even crooks can have a simple cypher that is unbreakable in a single message. So the FBI did not get a search warrant -- couldn't.

Instead they are doing a fishing expedition in the hopes of finding something, or of convincing the public of the acceptability of this action for future purposes.

Alternately, they know nothing is on the phone but want to give the appearance of doing everything possible after messing with the phone earlier.

Our culture is quickly dissolving in to "whom to blame if it doesn't work," and "how to take credit for something that did work"
with no concept of accountability. That is the real terrorism!

PRISM and XKEYSCORE and other programs revealed by Snowden make it clear that your Skype calls, Internet histories, YouTube videos, emails, phone data, webcam data, library books are already captured and stored on a mass, regular basis by the NSA. Keep up. Thank you, Ed Snowden for your service.

In addition, Google, Apple, and Microsoft, have been subpoena-ed thousands of times and complied, giving over cloud back-ups. It's not like this is a brand new development.

So why is Apple pushing back now? Probably they saw what happened to Cisco routers. When it was revealed that the NSA was compromising the security of Cisco routers by secretly altering their firmware, Cisco's domestic and international sales dropped at the very time that the US was accusing China of "cyber warfare:"

My guess--and admittedly it's speculative--is that the FBI is crying that they don't have the same capability as the NSA.

YouTube was mentioned in that it would teach someone how to hack an iPhone. The lrograms that I listed are not on YouTube as a how to use it as it's not avail able. Ease keep up with the times.

Yes, the programs you listed have tutorials all over the internet explaining how to install them, how to use them, and even how to modify them so they work better than the government's versions of them.

The fact that none of those programs hack an encrypted iphone is irrelevant being as how none of those programs were written to hack an encrypted iphone; this is a situation where the government realizes someone has finally locked them out, and they don't like that.

Apple claims there are at least 12 All Writs orders and ex parte applications to consider from DOJ to date.
