I have in mind some ideas for a gimmicked Bicycle Brand playing card, as well as a gimmicked Bicycle brand card box.
I was curious if I pursued such a thing the legalities of marketing and selling such an item. Do you have to pay Biccyle to use their patter in making such gaffs? Does anyone have firsthand knowledge on this? Dan |

Not first-hand info, but this is well-known.
As long as you do not change the standard artwork of the back of the typical Bicycle Rider Back, then you have passed hurdle one. If you change the back, even a little bit, then you have a problem. The other two no-no's are changing the joker artwork or the ace of spades artwork. Bicycle will not allow changes in any of these 3 areas. A change is a difference in the actual shape or fill of their artwork. Bicycle allows color changes. If you are buying Bicycle cards and boxes and modifying them for sale, as long as you avoid the no-no's above, you should be fine. If you are going to print and sell your own items with a Bicycle brand visible, you will probably have to deal with USPCC directly. |

Yes. I was thinking of printing and selling my own items with a Bicycle brand visible, for exhale a gimmicked box.

I think if you were to change them for yourself and your own use it's ok, but to sell, DelMagic is correct about the rules. But with the Mandolin decks Bicycle is more open.

It may be "essentially free" to get their permission, but getting in touch with the right folks may not be straightforward.
*Technically* the imagery, art, etc., is under copyright, and even duplication (for whatever purpose) could be construed as breaking certain U.S. and/or international laws (where they apply). That said, you can clearly see in the industry that it's a relatively common practice to utilize "bikes" (or things that look like them). My understanding: If you are selling a "hand-made", "second-hand", "craft" **gimicked box** (for example) -- and not specifically marketing "a USPCC, Bicycle" box, you are probably alright. It's definitely a good idea to try to track down some contact info tho, esp. when attempting to use trademarked/copyrighted imagery, content, etc. So good on you! If you find a specific legal contact, post it here! =) |
