I've been ticketed, (court date as it stands is Feb. 13) and threatened with jail. In spite of the fact that I'm playing on a public sidewalk and busking is now "legal" in this city. I'm getting too old to keep running all over the world chasing pitches that are acceptable to the powers that be. I need to make a stand where I am.

Don't let the bar stewards get you down.

My knowledge of U.S. law and how it varies from state to state is pretty sketchy,
but it looks like a good case for a caring Civil Rights lawyer.

If it's going to cost, and I'm sure it will, I can send a few "hats" and some of my pension.
I'm sure there's plenty of people more than happy to support your defence.
It's an issue that affects everyone. Our way of life, and primary means of expression is under
attack. Ultimately if we are forced off the streets all the world will be the poorer for it.

Visiting my daughter, in Hannover,
last month,
....on my birthday (😂)
the weather was sunny,..
we played,..
we were sent away,..
we stayed.

We yelled,
screamed,
....slept 26 days in a cage, with no hot lady next to me,..
life can be hard.

Heya Eric,
I feel for ya.
Hope it all works out for you. It's a fustrating battle, for sure.
My travel bug days have very much diminished & I also just want to play my local pitches.
But, as in most places on this, it's constantly been a battle, even up here in the Great White North.
From my experience in fighting for pitches.....what success I've had, is by working behind the scenes.
It's been a long process...meeting with the mayor....volunteering for organizations attached to administration...working behind the scenes, meeting those in charge, BIA's.
All to put a positive face on busking, to have a little bit of influence.
Most of it at my expense, both time & money. A lot of it fruitless & thankless.
But sometimes I have been able to sway a decision in favour of allowing Street Performing.
Eric, you are an asset to the community, making the city a better and happier place for all. One of the best out there IMHO. Hopefully the decision makers in San Antonio come to there senses.

Thanks very much for the responses guys, it means a lot to me. To hear such words of encouragement and support is heartening.

Today I went out and did two shows on the pitch without hatting my audiences. Several people approached me trying to press some money in my hand but I successfully avoided their thoughtful actions. One fella did manage to give me $8, hiding it in a bag that contained a drink and a few snacks that he'd bought for me, bastage.

I have several things to take care over the New Year's holiday, but after that, I may go back and continue to play there. I might try a virtual hat or something similar. If it goes all right, I may be able to outlast these sticks in the mud and eventually secure a beautiful pitch, in a very beautiful city.

I'm not a lawyer, and you should speak to someone who is.

However, preventing someone from busking has been ruled a violation of first amendment rights, as far as I know.

You are allowed to perform in a public space. You are allowed to ask for money in a public space. There's no logical reason you can't do both at the same time in the US.

In Vegas I have not had much of a problem, however there is a "street performers" union. In fact, they are currently in the process of suing Clark County for violation of street performers 1st Amendment rights. There is a general meeting Feb. 1 to update everyone.

Normally if the police want to hassle you here it's based on "obstructing a public walkway" (if you use a table) or "interrupting the flow of traffic" if your crowds are deemed too big. Generally if you are doing a real show and not being too aggressive with people while drawing your edge, you're okay here.

That's about it. I was done, they knocked me out. Even when I just did a couple of shows without hatting, I was still worried that they'd cart me off to jail.
I can't change the court date by phone, in fact I couldn't talk to anyone until I went by the courthouse, due to their automated system that just provides information. I went by and they told me that the only thing I could do was to write the judge. I won't know when my court date is until the ticket is filed and the person I spoke with said that it doesn't have to be filed until the court date that was indicated on my ticket. As a result of that lovely information, I took off to New Orleans hoping to get a few days in before my daughter's baby decided she was ready to enter the world. I made it all the way there, spent a cold windy afternoon in the french quarter the next day only to receive a phone call from one of my other daughters that they're inducing labor because of complications. It was a long drive back to Uvalde, but I made it in time to see my second grand daughter born. What a wonderful miracle that was!

Now that I am reminded why I do what I do, I'll be back out on the Alamo pitch tomorrow afternoon/evening. Provided the rain holds back. I don't plan on being in town long, but I'll do what I can while I'm here.

Gallagher, I'm so sorry that you had to pay for changing times in such a brutal way.

I'm really sorry that I haven't replied to all the comments but time and connections are at a premium these days.
