Hey Eric,
thanks for clarifying. Nö offense intended,.. extreme, or minimal. I was 'suspici-fying', because "enviromental" had been mentioned. That led me to think,.. "hmm? Too loud,... or, he's leaving the place,...littered? Probably making sö much money(!), he's letting half of it there! (littering), Or, an amp." {Now you know why my wife always says, "We're in trouble now! He's thinking!!!} I am really sorry. There was no malice intented. The use of Amps, I don't need to discuss here. Cb mentioned advice from Eddie Tulock, however. Cb,...I like to hear more,.. maybe a new Thread? I'd apreciate it. I always enjoy your insights. Eric, I wish you luck,... Nö,.. I wish you JUSTICE! a partner in arms, Gallagher p.s.: I really apreciate and honour the ablity to clear air, using Logic and Dialogue. The ablity and freedom to express ourselves. Our thoughts, views, querries,... "right or wrong",... wonder. I believe with these tools, ALL is possible. ,....maybe even a good back-palm! 🙃 |

I have always tried to live my life honestly (I'm a street performer with solid friends), in every way I possibly could. To be accused of deceiving my peers is one of the most profound insults/affronts, I can imagine.
That having been said, I too believe that logic and dialog are essential to living a rational and happy life, and in that spirit it's all good. (Or will eventually work out that way in the final analysis anyway.) MVoss, I too echo gallagher's sentiment, thank you very much for a very informative, and helpful post. I will be much better armed for the information you've provided me. |

To Ed Rhodes, I figure if the judge sees that I'm not merely a crack pot, but there are actual people that are familiar with what I do and have done for many years and enjoy it, then I might have a better chance of getting the case dismissed and start to win over the city council (if that's even possible). In the interest of winning, I'm willing to risk a negative perception of what support I'm potentially shown. |

A fond memory, I had met Cellini in New Orleans, for his lecture there (2001?). At some point, we all met up at Jon Rauchebaumer's (sp? [friggn french]) Knights of Sleights meeting. Jim suggested that I show the boys a trick, I chose to do my coin routine. Afterwards, I headed to an area of the bar where I could smoke, on the meandering way Cellini walked by me with a big smile on his face. I asked him what's so funny, he stopped, gestured back over his shoulder to the boys and said "they think you're a coin man." |

Yesterday I was at the court at 8:00 am. I spoke with the prosecutor prior to my case being called before the judge. As the officer who had originally ticketed me didn't show, the court chose to dismiss my case.
Regardless of the outcome, the damage remains the same. I've done several shows on the pitch since being ticketed but the fact is that the possibility of being arrested has really gotten inside my head while performing there. And as I'm the sole caretaker of my 16 year old daughter, I can't afford to go to jail. So, I'm off in search of another pitch in another city. Many, many thanks to those who've afforded me advice and assistance here. Perhaps I'll see you up the road. |

Responsibility is a drag, but at least they dismissed the case. Glad it worked out in the end. Happy Trails.

good news! ...kinda. It is a drag, that psychological bagage.... I almost wrote "garbage"(!). 🙃 Somehow, "I", standing here, 30,000 miles away, at a really safe distance(🙃); would say, "You've gotta go back,... play the Pitch again." Otherwise, 'they' win. I'd love to tell you, "I'd be there tomorrow pounding the pavement!...." ,but knowing me.. 🙃 Another story for the Book! Though the case was dismissed by the prosecutors, the damage is done. |

Is there a chance of talking directly with the police force leaders? Was it one policeman throwing his weight around, or is it systemic?

It's City Hall. Talking with the police won't do any good, they're just doing what the City Council has told them to do; enforce unconstitutional laws.
I did two shows tonight, likely my last there. While performing there some weeks ago I had another "magician/balloon clown" interrupt my show, saying that I wasn't allowed to be there, he was working in front of Ripley's. The fact that Ripley's was paying him to goof around (no crowd, no show) I imagine he accosted me because he was looking after his job security. And tonight, I'm pretty sure a musician, guitarist, called me in and that's why the police showed up. All in all a bunch of no-nothing amateurs here in the streets. At least I got a couple of shows in before they ran me off and now I have enough money to get the hell out of this town. |

Come to NYC young man. Tourist season is about to start and we don't have enough quality street magicians.
There's plenty of room for everybody here.

Everyone likes to jump my crap because I won't preach the gospel of Chance, but as a criminal justice major I know this is EXACTLY how the "system" works. They can arrest a ham sandwich if they want, you don't have to be guilty of anything to be arrested. And just because you are arrested doesn't mean you will get your day in court ... they arrest people knowing the charges would never hold up, that is how the system is setup. The system is not broken, it is doing EXACTLY what is was designed to do.
We couldn't even count how many innocent people are held in jails for months at a time simply because they can't afford bail - even if they are found not guilty, they still get nothing back for their time. The system is not about justice, it is about getting what the government wants. I feel for you Eric, I really do ... I have been watching this thread since the beginning and keep trying to come up with some advice for you. Sadly, I still have none. Find a private pitch maybe, Ripely's for example ... if you have permission to be on private property they can't arrest you - the police can't even walk on private property to watch your show without permission, kind of like turning the tables on them. Yeah, leading up to my court date, my son kept telling me that the law wasn't about right and wrong, it was all about control. Then I read an article about how cities pass laws that they know are unconstitutional but can afford to drag litigants through court for years, defending laws that they know are wrong but have every motivation to pursue due to their invested interests. Sounds a lot like what you're talking about. |

It seems to me, in this case, the system is working.
There is a 'structure',..rules and regs. for Performers. There is 'Enforcment'. And there is someone watching over it all,..the Judg-ess. AND, everybody seems to be playing their part. To me, it only looks, as though, one guy is a little bit out sync. Normally, at this point, everyone would think,..."the Busker!" ,but,....ain't so. 🙃 The system IS working. I think Doc Yoder is right. 👍 "Time to talk." Continue working within the system. I believe, I really believe,... especially in the U.S., it's the best thing going. What we have to start doing, though, is taking up our part. Explaining our rights and positions. The 'dirty work', has already been done. It's time to clarify. Calmly go down to the Police Station, and talk to 'the Man'. (i BET, you could even get a gig out of the transaction!) What's the worst that could happen? Toronto, South Dakota will still be there next week! (remember Cellini's line, "....and certain parts of South Dakota."? NOW we know!) Eric, the hard parts done. Go and talk. gallagher |

Thanks gallagher, but I've already spoken with the police many times. They're just interested in enforcing the laws as they're told to.
The people that matter are the ones that write; create the laws. I've put many a call into the city councilman who's district is overseeing the Alamo area. I've put numerous calls into the Mayor's office. I've placed many calls with even the local radio stations news departments. Never spoke with an actual person, just left messages informing them briefly on the subject(s) matter. I never was the benefactor of a reply; a call back. Now maybe you know something I don't, however, I'd much rather spend my time effectively as I may have little of it left. The Po-po just do as they're told by those who sign their checks. So why talk to them exactly? Ideological castles aside, enlighten me please. |

I'm sure you know the situation better then I. Sounds like they've got you over a barrel. (...hopefully a barrel of Rum! 😋) I'm sorry to hear it. I always, somehow hope, cities and Performers can reach understandings. It's sö funny how we both need the other! I wish you well.
