I have come across a seller on eBay ( I will give a link to anyone who PMs me) who is selling magic books that are still in Copyright and in many cases the authors are still living. I am in the uk, this seller is in the UK. I want to do something to stop it, any advice please.

I have reported things like this to eBay in the past and they do not get back to you, other than to acknowledge your complaint, and no action appears to be taken.

A few examples
1 - Card College by Roberto Giobbi, all 5 DVDs for £5 inc postage
2 - Dai Vernon "Ultimate Secrets of Card Magic" - this one is on a compilation he has put together of over 350 books that are too numerous to list, Larry Becker, Harry Lorayne etc etc. Name almost any top mentalist or magician and this guy is selling his material.

I assume you mean he's selling eBooks of these titles?

The only thing that can be done in that case is the copyright holder has to report it. Also, eBay is terrible on copyright infringement. They just do not care at all.

A little good news...

I messaged the seller on eBay saying that unless the listings were removed within 24 hours I would:-
1 - Contact the police
2 - Contact FACT (Federation Against Copyright Theft)
3 - Contact eBay

The listing of 350 eBooks on one DVD was immediately removed however,
the 5 DVD set of "Card College" by Roberto Giobbi for £5, is still listed,

I applaud your efforts to help combat copyright infringement and piracy.

But just like WitchDocChris said, eBay is awful in policing things like that and piracy is so rampant on that site it's ridiculous. I own a small software company ( www.ipokerbot.com ) and scour eBay at least twice a week to remove my software being sold illegally. Yes, the only way for them to take immediate action is by you providing proof of ownership.

Kuddos for writing that person directly and speaking your mind.

Funny coincidence-- I think I spotted the same guy. I reported him to eBay using the "Report This Item" link-- but he's still there. (Or maybe they shut down his previous auction and he put up a new one-- I'm not sure.)

Is it "g***tsmagic"? I'm not going to include the whole name or a link because I don't want to give him the publicity.

Looking at his feedback from previous auctions, he seems to regularly sell pirated stuff on DVD and memory sticks.

The only thing I can suggest is that, if enough people click on the "Report This Item" link and report him to eBay, they may eventually take action. But he'll probably just pop up under a new name. It's depressing.

Hi Jacob
yes I think that is the guy (it's been a while). I notice that he currently has nothing for sale.

We recently managed to get a product removed from eBay. Have the copyright holder contact us.
We're fighting piracy and exposure for the magic community. We issue copyright claims on videos, links, and web pages and get them taken down.
