Well, I feel stupid.

I was taken to lunch today at a coffee shop by a writer who was using me as a consultant. He is working on a TV show which will feature a kid doing magic having to perform an escape when captured by the old meanie. I think I did a good job of helping him design the escape without giving any trade secrets away.

He had asked about picking locks, and I did not have a padlock with me, but I did show him what my lock pick set looks like. I had them out on the table, just as a cop comes out of the nearby bathroom and walks right by the table.

The cop either did not see them, or couldn't be bothered, but whatever it was I did not get busted, nor were they confiscated.

Teach me to watch my surroundings.

If you weren't using them to commit a crime, the mere possession of owning lock-picks (in CALIFORNIA)...is perfectly legal.

The officer would have had no reason to confiscate them, nor to even talk to you.

I once lost my wallet (with lock-picks inside) in a very conservative part of Los Angeles (Burbank). The wallet was turned into the police department. A week later the PD phoned me to come in and claim my wallet. They returned the wallet, and they had individually "bagged" each lock-pick, and returned them to me. No questions asked. Obviously, they had a whole week to check on my background, as they had my ID and credit cards.

In short, the mere possession of lock-picks was and is perfectly legal (in Calif.)...if you aren't a felon, and not engaging in a crime.

btw- If you had a pair of handcuffs laying on your table - again, there is nothing illegal about owning them.

Cliff--Congratulations on your consulting gig.

It seems that the CA law is similar to that in AZ (indeed, in most states). It's all about possession in the act of a crime or the *intent* of committing said crime (which is hard to prove).

I'd love to see this TV show, Cliff! Let us know how it goes!
Those who don't believe in magic will never find it.
